I think 371D is a hurdle. Let's see what T people are saying. Since AP is nullified, there is no need to remove it explicitly. But counter to that isAP still exists after division. Still zonal system exists hereby limited to only 3 zones. Also new capital comes in ap and it has to be free zone. So they have to amend the 371D. If they change AP name to some other, then 371D is nullified as state itself is not present | ||

Constitutionally only roadblock is 371(D) , any other issues we are hearing like T bill/ T resolution circling thru state assembly and all are NOT at all any issues. Parliament is paramount, ONLY parliament can do whatever they want So , let us focus only on 371D , listen to the two sides of 371(D) Ppl who argue 371(D) WILL BE a hurdle say : 1) 32nd amendment to the Constitution, two new articles 371 (D) and 371 (E) were inserted with the header "Special provisions with respect to Andhra Pradesh " 2) This amendment was then inserted into the 7th schedule 3) Article 368 clearly states that if any change is to be made under the 7th schedule, then it has to be adopted by a special majority. Both houses of Parliament have to pass the Bill with a two thirds majority. Such an amendment also has to be ratified by state legislatures. This means 50 per cent of the states have to give their nod in case the amendment has to be ratified. If the ruling United Progressive Alliance agrees to the creation of a separate state and seeks a Constitutional Amendment, it would require a special majority and the agreement of 50 per cent of Indian states. Ppl who argue 371(D) WILL NOT BE any hurdle say : Article 371E was added to constitute a Central university in Hyderabad. Once the university got established, the Article became useless. Similarly, if Telangana is carved out, Article 371D becomes redundant and thus needs to be removed by an amendment to the Constitution. It's an enabling provision empowering the executive just to make an order. Earlier, Article 371 was facilitating Regional Committee for Telangana within Andhra Pradesh. But 371D will not be an impediment in the formation of Telangana. MY UNDERSTANDING AFTER READING BOTH SIDES : 1) Only Supreme COURT may decide which argument WINS ! and there is definitely a strong case !! 2) UPA govt also foreseeing a legal tangle and ordered Group of Ministers to work on this.
