This rule was introduced recently last year or 2017. This happened in 2016.

So, just checked the paycheck

Last working day was 3rd June 2016.
Pay check lo pay period is till 10th of June ani undi.
Candidate left on 12th of June.

1. Have you ever been unlawfully present, overstayed the amount of time granted by an immigration official (No)
2. or otherwise violated the terms of a U.S. visa?.. (Yes).
Hence lawyer suggested answering the question in affirmative.

Out of status is different from unlawful presence..so he should put it as NO anukuntunnaa..bcos he still had a valid visa and i-94..he just did not get paid which will make him out of status..unlawfully present ante i-94 expire aipoyaaka koodaa stay cheyyadam..anyway attorney is the right person to tell..

H1 meeda fire aina date / last date nundi we can legally stay upto 60 days kada and that will not count as out of status or violation of status kada , am i missing something here ?

may or may not... but still they can answer the same, that wont effect on the visa approval... all they need to see is reason genuine aa kaada... better to elaborate as much as info in ds-160 stage itself

Ok...it is marked as "Yes" and provided valid reason. The question is what kind of questions we can expect in interview and is it really big thing

situation idi.

So company closed their office (layed off everyone) say June 3rd 2016 (friday). At that time the person had valid VISA and I-94 till Oct-2017.

Applied immediately for another job in the same area and had interviews on Monday and got offer letter on Tuesday. Signed the offer letter, submitted docs for H1B transfer, booked tickets via old employer and then left to India next sunday (12th). So, literally stayed for 8 days after losing job.

This was attorney's recommendation to better you go out of country until you get the H1B approval

New employer filed in permium after 2 weeks got approval and then started to work from first week of Jan. Travelled back using old VISA but showed I-797 at POE.

In the new work, again applied for amendment (Got promotion) got extension and now going to India for stamping.
