Filing of Amendment Required for ANY Material Change

On the current I-129 form, the instructions do not specify the correct selection of the classification options. The revised instructions explain the classification options. Portions of these instructions are troubling. There is an instruction to select the option for filing an amendment with the USCIS if there is any material change. The example given of a material change is a change in primary job duties or a change in the geographic location of the job.


H1B petitions must be amended when there is a material change. However, under the current Adjudicator's Field Manual and advisory letters, H1B petitions do not always need to be amended when there is simply a change in the location of employment. It is necessary to have a valid labor condition application (LCA) for the new location. If the USCIS requires amending the H1B petition when the employee's job location changes, this will be highly burdensome to consulting companies or other employers with roving / traveling employees. The H1B amendment is not simply a brief update or shortened filing. It is another filing of the H1B petition and requires satisfaction of all the filing requirements.
