In an exhaustive submission running into 87 pages, Shah has charged that Justice Chatterjee ordered the CBI probe under pressure from the Centre since he was himself being probed by the same agency in the PF scam. At the same time, Shah has also raised the serious question as to why the probe against the retired judge has been soft-peddled by the CBI. Mocking at the CBI claim of âno prosecutable evidenceâ against retired Supreme Court judge Justice Tarun Chatterjee in the provident fund scam, Shah has told the Supreme Court that such a concession could not be given once the judge was found guilty of serious acts of âomission and commissionâ. âThe finding of âno prosecutable evidenceâ recorded by the CBI, which was investigating him (Justice Chatterjee) and which even afterwards has not found him innocentâ¦is unknown to criminal law so far,â Shah said. In support of his contention, Shah quoted portions of the affidavit filed by the CBI before another Bench of the Supreme Court monitoring the PF scam investigation. It said, âInvestigation was also conducted with regard to the allegations of receipt of valuables/services by various judges/judicial officers. However for want of sufficient evidence, their names are not recommended for prosecution.â The CBI affidavit further said, âA CBI report has been sent to the competent authorities for appropriate action against them for various acts of omission and commission on part of the 24 judges/judicial officers.â To supplement his charge, Shah also referred to a comment made by Attorney General Goolam E Vahanvati in the apex court during the hearing of the PF scam case that, âThere is no sufficient evidence to prosecute 24 judicial officers but findings against them are also of a serious nature.â This list of 24 judges included Justice Chatterjee as well. Hinting at the possibility that this circumstance was crucial to the decision of January 12 in deciding whether the Sohrabuddin encounter case be handed over to the CBI, Shahâs application suggested, âThe pending investigation in the PF scam against Justice Tarun Chatterjee (since retired) provided a strong reluctance to displease the CBI in the impugned order (of January 12) or make any finding that the CBI could not or would not impartially handle the investigation in the case sought to be transferred to it. So Justice Chatterjee could only have decided in favour of and not against ordering CBI investigation into the Sohrabuddin case.â On this ground, Shah has sought recall of the order claiming there was reasonable apprehension that the judge would have had a "conscious or an unconscious disinclination to record any finding adverse to the integrity and impartiality of CBI", knowing fully well that the CBI was investigating a case against him and the fact that the CBI was never known to act as a fair, independent probe agency. Shah, a close aide of Chief Minister Narendra Modi [ Images ], alleged that Justice Tarun Chatterjee (since retired) who as part of the Bench ordered the CBI probe in the case on January 12, was under the scanner of the investigating agency in the Uttar Pradesh [ Images ] Provident Fund Scam for "breach of trust". The 87-page application by Shah, which sought recall of the order, contended that the entire exercise was the result of "political conspiracy to launch an unconstitutional assault on the constitutionally formed and democratically elected Gujarat Government". The application prepared under the guidance of Senior advocate Ram Jethmalani, also questioned the propriety of Justice Aftab Alam in hearing the matter when he was aware that the name of Justice Chatterjee had cropped up in the PF scam and that CBI was probing his alleged involvement. "The January 12 order ought to be recalled on the ground of bias as there is reasonable possibility or likelihood that (retired) Justice Chatterjee who passed the order was biased and suffered from automatic disqualification to hear the case," the application said. It also spoke about Justice Alam saying that "if he was in the know of the fact that Justice Chatterjee suffered from automatic disqualification, he too ought to have recused himself". The application by Shah has also raised some points identical to that mentioned in the curative petition filed by senior IPS officer Geeta Johri, who alleged that the CBI was proceeding in the case with a particular political colour. Like Johri, the former minister also alleged the CBI was coercing witnesses to depose in a particular manner and deputed a officer, who was questioned in connection with the case. He also demanded removal of Balwinder Singh, special CBI director from the probe, as he was interrogated in connection with the case when he was the Commissioner of Police, Hyderabad. Asking why the CBI is not investigating the role of the Andhra Pradesh Police in the alleged abduction, Shah sought the removal of Kandaswamy, IPS, who is in-charge of the investigation. He said that the "most shocking aspect of the CBI investigation is that Balwinder Singh who ought to be answering questions from any investigator of the Sobrabuddin encounter on the role of the AP police is now supervising the very investigation and Geetha Johri, who as the head of the Gujarat CID Crime was heading the investigation of the Sohrabuddin encounter and was wanting to question Balwinder Singh, is now being questioned and even threatened with arrest." |
