How can she work without SSN? And SSN office will not give the dependents SSN without proper documentation. complex scenario : entering on H4 stamped , even though h1 is approved already due to AOS. if she reentered on H-4, after the approval of the H-1, she can NOT start work right away. She is back on H-4. I stick to my point. There are no restrictions in transfer from H4 to H1B. Once she is here on H4, you can apply for her H1 visa. yes OT. one case example: when h4 to h1(inside usa): She only retains her H-1B status while she is working for that employer, so she should immediately file an I-539 to change back to an H-4. there is no question of I94 gets invalid coz she gets I-94 valid until 2011 when new company filed for my extension Cool. This is sometimes overlooked and the consequences in some cases I know have been really bad. Because law firms do not know the marital status of the H1 candidate and so sometimes they file extension only for the H1 without extension for I94 for dependents. | ||

If the company that sponsored H1 is reputable and problem emi vundadu anukunte, better to get stamped for H1, saves her a trip to the consulate when she goes back to India next time. Otherwise, risk enduku anukunte, she can appear for H4, come here start working and when she goes to India next time, attend visa interview for H1 and come back on H1(at that point it will most likely be much easier for her, since she would have worked for sometime and would be able to produce pay stubs etc..in case they ask). | ||

1. On H1, I have valid visa until sep'08 2. My Wife is on H4 with valid visa until sep'08 3. Jan I changed company and got extension until '11 4. April lo wife ki H1 file chesthe with Change of status* 5. Assume she got her H1 papers in July 6. She need to go India in August for her sis marriage Question: 1. Does she need to attend interview on H4 (for the H1 I got valid for 2011) 2. Does she need to attend interview on H1? (If she get stamped, Visa will be valid from October), Aug-sep she cant come to US? |
