Ustad, According to 21st century act, 1) To get 1 year extension you need to have your PERM in pending or approved status, and that PERM must have been applied 1 year ago. If you applied I140 and if it's in pending status, you still get 1 year extension only beyond your usual 6 year limit. 2) If your I140 is approved, you can get a 3 year extension beyond 6 year limit. In such cases it does not matter whether you applied your labor an year ago or not, all you need is I140 in approved status. 3) If you have I140 approved on company A, you can get a 3 year extension on company B, this was clarified in 2005 William Yates' memo. Thanks Mav....one more question....Say, Company A files for my GC and I am working for Company B....At the end of 5th Yr of my H-1 if I got 140 cleared (through Company A)....Will I get 3 Yrs Extension after 6 Yrs (I am still working for Company B)???? | ||

before start of 6th year you need to file and have pending, no need to have approved PERM | ||

Guys....before end of 5th Year of H-1....Do we need to get Perm Approved to get 1 Yr Extension after 6th yr....or it is ok even if you just apply (pending status) for Perm before end of 5th Year. Moreover, How about 3 yrs extension after 6th years of H-1....I think we need to get 140 Approved (not pending) before End of 5th Yr, correct?? |
