Yes, I guess the lacking thing is that many among the top leaders are still with an NGO mindset. They fail to recognize that they are in a competitive environment. And thanks to the media too, which only needs burnt down buses, road shows for news. Make sure that you maintain a count on how many times you oppose PRP and TDP and Cong. Yes, sadly even many educated ppl do not understand that the democratic way to fight Govt's policies is in the court, but not on the roads. They fail to understand the difference b/n protesting against a foreign rule (aka the British), and protesting against our own Govt. Standing on a bus top in the middle of the road will 100s of ppl around and giving out sentimental speeches defines a leader. The A. P. High Court on Monday upheld the action of the State government in seeking to regularise structure built in violation of rules by collection of a penalty, but imposed several stringent conditions for giving the green signal. It made it clear that open spaces, land use rules, structural safety and fire safety norms cannot be compromised. In a 105-page judgement, a Division Bench set aside the government’s proposal not to insist on structural safety condition for buildings below 15 metres height. It made it clear that no structure can be regularised if it violated the land use indicated in zonal regularisation. Thus, non-residential buildings cannot be regularised within residential zone. Comprising Justice V. Eswaraiah and Justice Vilas Afzalpurkar, the Bench was disposing of a batch of writ petitions challenging the Act which amended Municipalities Act, Municipal Corporations Act and Urban Areas Development Act. More specifically, the petitioners challenged GOMs 901 framing the rules for what has come to be known as the Building Penalisation Scheme (BPS) applicable to all municipalities. Forum for Better Hyderabad, represented by its Secretary, O.M. Dibara, and the Lok Satta Party, filed public interest petitions against such regularisation. Speaking through Justice Afzalpurkar, the Bench did not appreciate the government’s action in giving relaxations for regularisation with regard to the illegal constructions in open spaces in municipal areas. It also felt that the penalty of 10 per cent of the total value was too less and would encourage unscrupulous builders to get away by paying the paltry fine. While framing the rules, the fine should be increased to such an extent so as to serve as a deterrent.
