As per my opinion, if EB2 old i-140 is still pending, i.e even after it is rejected , you reopened it and it is still pending then you can apply for EAD for pending 1485; Again you applied for another 140 on EB3 , then you cannot apply for EAD on EB3, Answer is really it depends and you should consult a lawyer | ||

EB2 I-140 ni 'Appeal to commissioner ani eedho chessaru' and it is still pending. So I -485 also pending. Ippudu aa Same labour meedha EB3 I140 approve ayyundhi He didn't get any rejection notice for I-485..Ofcourse his spouse got. I Love India | ||

maa colleague oka athanu..nannu oka question adigaadu ..nenu meeku post thunna Actaul labor is Aug 2006 EB2...2007 July jackpot lo EAD vachhesindhi. 2008 lo I -140 reject ayyundhi.I-485 is still pending. His Spouse I -485 got rejected. he never used EAD and still continuing on H1B only. Tharvatha EB2 labour ki RFE/or something apply chesi ..EB3 lo I-140 apply chesaru..And it is approved now. Now his question is..can he apply for EAD..Since he has pending I-485?? Naakunaa knowledge tho NO anukunta..ani cheppanu..because the actual labour & I-140 are changed in that 485.. Inkaa eeminaa loop holes vunte cheppandi. I Love India |
