logic is simple. irrespective of your status/ead/noead/h1b etc THE WAY YOU GAIN ACCESS BAck to AMERICA will Determine your STATUS AFTER ENTRY. if u use PAROLE, PAROLE's cannot WORK, and Hence EAD @ REQUIRED for future JOB in usa. if u keep PAROLE in pocket just for the NAAM KE VASTHE (ur contunuing h1b till now), and come back by showing STAMPING, then you continue to be in H1b. ead is a secondary option for future jobs. I would also suggest to her to STAMP with H1b as far as possible. Fedex the petetion to her to india. she can try h1b stamping in india. if she gets stamped, WELLL & GOOOOOD, she can be thru h1b status when back if she gets some stamping problem, still she can use PAROLE. if she gets a CONSULATE stamp, she is back on H1b. My wife is on H1B visa. She got EAD and travel document sponsored by my company. She applied for her H1B extension and she hasn't got her approval yet. Her h1B expired on Sep 3oth. She is expecting it to be approved in a week or two. We are planning to go to India last week of this month and will be back by 15th Dec. My question is: can she use her travel document (Advanced parole) while coming back without getting her H1B stamped in india?? She doesn't want to use her EAD though. If she uses her advanced parole, does it mean that she is using her EAD??? Any comments??? |
