If employer requested to withdraw 140, USCIS will not revoke since his 485 has been pending for more than 180 days. But since they know he has moved on, they might send a NOID asking to provide information on where he is working, job details etc.(bear in mind, this is the worst case scenario). He will be ok if he replied to that. Nothing to worry really!! | ||

Nothing will happen. If 140 is approved ask him to relax. No matter what the employer does, the worst thing that can happen is an NOID(even this is a remote possibility, IMHO). Even if there's a NOID he can reply back with details of where he is working, his postion etc. There's absolutely no need to worry. The only thing to be aware of is that NOIDs need to replied within 30 days as opposed to RFE(which has 3months). | ||

Off late USCIS has been sending some NOIDs for cases where the initial 140 has been revoked. So ask your cousin to be prepared in case there is an RFE/NOID from USCIS in that regard...otherwise he should be fine.. The employer has every right to revoke 140 because it goes against his ability to pay and if this guy has moved on then it might become difficult for him to file further Green Card LCs | ||

If 140 is approved, then even if employer revokes the petition then nothing happens. But if it is not approved and he withdraws there is a bit of risk. I have used AC21 . But I didnt risk withdrawal because my GC petition was filed by a big corporation and they didn't bother. I didn't have issues | ||

nopr its doesnt matter, if he moved after 180 days then ask him dont worry if old employer is giving trouble, you can hire another attorney and ask him to contact USCIS and get all his papers | ||
