Uppu:Do not take risk, go for I551 stamping. Before going for stamoing. take copy of notice and keep it with you. Some times while coming back some indian officers irritate you because the they do not know I551 stamping. No where it tells you that your green card is approved. At that time you can show the copy of your approval notice

Forget about H1, you should not enter on it now. mee lawyer gaadu emantannadu. Entering on H1 is out of question as you are already an immigrant. Now the question if you can enter using AP, with out I-551. It would take just an our at local USCIS office to get an I-551. What's your lawyer saying?

Yes you can not come back with H1 visa. Once of my Collogue 485 iss approved when he is india. Company asked him to waith until he get his Adnace parole. |

Getting a I-551 stamp is the safest approach. They might let you enter on AP, but as I said, the safest thing to do is I-551 stamp. If the applciation was approved while you were already in India, you could have entered with AP with out any doubt.
It's very easy to get a I-551 stamp. BTW, what's your lawyer's opinion. BTW, why do you want to enter on AP and go to you side room waiting, when you can enter royally with I-551 stamp, which is as good as having a physical GC with you???

Since you will be filing I-485 alone, you need to follow the following.
In case, where I-140 is still pending, 485 application should go to Service Center where the I-140 is pending. Since your I-140 is already approved, it doesn't apply to you.
Since your I-140 is already approved, You should file your I-485, when your turn comes, at
Nebraska Service Center if the you reside in : Alaska, Arizona, California, Colorado, Guam, Hawaii, Idaho, Illinois, Indiana, Iowa, Kansas, Michigan, Minnesota, Missouri, Montana, Nebraska, Nevada, North Dakota, Ohio, Oregon, South Dakota, Utah, Washington, Wisconsin, or Wyoming
or file at the Texas Service Center if you resid in: Alabama, Arkansas, Connecticut, Delaware, the District of Columbia, Florida, Georgia, KenÂtucky, Louisiana, Maine, Maryland, Massachusetts, Mississippi, New Hampshire, New Jersey, New Mexico, New York, North Carolina, South Carolina, Oklahoma, Pennsylvania, Puerto Rico, Rhode Island, Tennessee, Texas, Vermont, Virginia, U.S. Virgin Islands, or West Virginia
Now coming to your worry about one center being faster than the other: There is nothing you or anyone can do about USCIS atrocities. People with PDs of 2005 and 2006 are getting approved, while applications from 2001, 2003, 2003 are rotting in centers with out any info even after opening several SRs and filings with ombudsman. Just a month ago, Texas was approving few 485's while Nebraska has been slow and steady. At the end it all boils down to luck and whims and fancies of the IOs and the mood of the IO looking at your aplication. Unless the FIFO order is maintained at USCIS, and they publish the details of the 485's on a monthly basis and they are made accountable, this chaotic process would continue, and the whole GC process for some people would be 2 years while several people will keep waiting for number of years...

If you have an approved I-140 from current working company(A), and if you are worried about your future immigration status, it's a good idea to apply for H1 on another company(B) and get a 3 year extension. Once the H1 is taken care of, think about porting the I-140 keeping the old labor date, by starting the GC with new comapny by applying labor and then 140 again.

Unorthodox, Mine is not concurrent filing..I missed that date by a week..anyway my 140 is already approved (from Texas service center)and PD is June 2007..waiting for the PD to get current..now when I apply 485 it should go to Texas center again right?? I'm just curious as it seems Texas center is much faster in processing the cases..thanks |

It depends on whether yours is a concurrent filing or not, as the service center address depends on that and as well as the address of the company applying for EB based permanent residence. Look at your I-140 and I-485 receipt numbers and if they start with LIN, it's nebraska, with SRC it's Texas, with WAC it's California. Sometimes even if you filed at Texas it's receipted at California center and you will get a WAC number. Where your application is receipted at, need not be same as which center your application currently is at.
For example, if you filed at Texas, it could be receipted at California and the file could be later moved back to Texas, usually in this situation, you will get a regular mail saying your application is moved to Texas and now pending at that center. You might try taking an infopass and ask the IO this question, but don't expect an answer from IO. But if I were you I would start looking at the receipt numbers. Did you ever get any mail suggesting that your file has been moved between centers?

It's tricky. If your labor is pending with current employer for more than an year, you should safeguard yourself by filing a H1 on another company and get a 1 year extension, as soon as you see that lay off is imminent. If your I-140 is approved, you should get a 3-year H1 extension on another company,as soon as you see layoff indications or better still if you apply now if you have a friend's company, and apply labor, I-140 on the new company when you join it, and port the priority date of the old company's labor. This way in the worst situation, you can use on the approved H1 of your new(friend's) company.
