Normally from what I know, before I-94 expiry you are supposed to leave country to avoid any future POR issues. I think it is better to get new visa status out of the country. but I am no lawyer. | ||

I had into similar situation 2 months back. Attorney recommended two options. 1. Apply passport renewel, than apply for h1b extension. We dont get just new I-94's. 2.Apply passport renewel, than go out of country come back.(in my case i had valid visa stamp on passport). I had ead also. but want to stay on h1b. So went outside of country and re-entered usa with new I-94 on h1b. They issued I-94 based on h1b validity. I contacted few cbp officers at the airports, but what they said contact uscis. They only issues new I-94 if there is any correction. In my case he said cbp issued I-94 based on passport expiery date, which valid and no mistake in there. So cbp offices stops issuing new I-94's for our cases from last year. I contacted uscis, they also said same two options, what attorney told. I hope this info helps you. No, you are wrong. VISA is based on your documentation / purpose etc etc. Passport is your identification anthe. for ex: Business visa / visitor visa multiple entries for 10 yrs ki isthaadu. kaani chaala mandiki passport expire date kanna ekkuva vuntundi visa validity. | ||

My husband's I94 was expired in Feb 2010 that we happened to find out 2 months after the expiry. At first he tried the local CBP with no luck, so we crossed the boarder of Mexico, Tijuana, and came back with a new I-94. Everything went smoothly at the boarder of Mexico. The officer was very nice and he asked my husband why he needed a new I-94 and then printed a new one for my husband right away. Murthy forum lo oo post | ||
