Chefs and hospitality management professionals can, depending on the specific details, use almost all of the non-immigrant visas available under US laws. An American residing out of the US, temporarily returning to the US from a foreign assignment, may bring a personal chef or cook to the US on a B-1 visa provided the said chef has worked overseas for the American for six months. A written contract verifying that the foreign national will be paid appropriate wages needs to be produced. Chefs employed by the large and prestigious hotels primarily engaged in management duties and not merely cooking may be granted H-1B visa. A young chef or cook wanting to know how a restaurant operates in the US may be eligible to receive a J-1 industrial trainee visa. It will allow him to work in the US for 18 months. Chefs with management responsibility employed by multinational companies may be eligible for intra-company transferee L-1A visa meant for managers and executives. A chef or cook with specialised knowledge may be eligible to receive an intra-company transferee L-1B visa. A chef possessing extraordinary ability may also be eligible to receive an O-1 visa.

Then they require labour certification which is the clearance by the US Department of Labour that there are no US workers able, willing, qualified and available for the position. A favourable treatment is often given by the department of labour as there has been a recognised shortage of foreign specialty cooks and chefs. The process begins with the submission of an application to the alien certification unit of the state workforce agency (SWA). The application has to be submitted in Form ETA-750 which lists information about the employer and the position. ETA-750B provides information about the foreign national employee and his or her qualifications. The date of receipt of the application by the SWA establishes the priority date for the purposes of eligibility to receive a permanent resident visa. The SWA will review the application and evaluate the appropriateness of the offered wage to the foreign national. It should be at least 95% of the prevailing wage determined by the SWA.

Once the issue of prevailing wage is resolved authority will be given to commence the recruitment by the employer to test the local market. To demonstrate the shortage of the US workers for the position indicated, the employer must test the local marketplace to ensure that there are no interested and qualified US workers. Once it is determined that there are no workers available in the US, labour certification will be granted. The foreign employee then will have to appear at the consulate in his home country for an immigrant visa interview. There he will have to demonstrate his capabilities. One should not be surprised if an Indian chef or cook is asked to prepare batata wada or idli-sambar at the immigrant visa interview.
