There is a perceptible difference from center to center, IO to IO, category to category, country of chargeability to country of chargeability when it comes to USCIS matters...a later filed 485 in one center may be approved earlier than an application filed earlier at a different center with same priority date, because of difference in processing dates...2 applications filed on same date, at the same center, with the same priority date, would usually have different approval dates, if different IOs look at their case...people are talking about writs on USCIS for this discrepancy...and you know change always happens at snail's pace... The state you reside in decides which service center the I-765 should go to... Which service center your pending I-485 is at, does not decide where your I-765 application would go... Here are my case details: My 485 is at Texas, because my labor was from IL office...but I live in CA which falls under Nebraska Service Center and my I-765 EAD application should go to Nebraska, though my pending I-485 is at Texas service center... Firehawk, Use the EAD paper filing procedure with the following cautions 1) I never volunteer information to USCIS by sending more docs than is necessary...people often send copies of driver's license, 485 receipt, 3 pages from passport containing biographical information blah...blah... which are not mentioned at all in the I-765 instructions PDF... 2) I paper filed recently 5 days ago, and I am yet to get receipt notice from USCIS...leave alone getting the EAD renewed... Filing procedure: 1) Go to this link and download the 2 PDFs at the boom of the page; I-765 application and I-765 instructions http://www.uscis.gov/portal/site/uscis/menuitem.5af9bb95919f 35e66f614176543f6d1a/?vgnextoid=73ddd59cb7a5d010VgnVCM100000 48f3d6a1RCRD&vgnextchannel=db029c7755cb9010VgnVCM10000045f3d 6a1RCRD 2) Send the envelope with following list of items to the service center address depending on the state you currently reside in...for example, I live in CA, and though my 485 application is pending at Texas, I send my I-765 to Nebraska service center...see the instructions doc... a) Filled I-765 form b) A check of $340 payable to 'U.S. Department of Homeland security' c) 2 Paasport photos (Write your name and A# lightly on the back of photographs) d) Front and back photocopies of current EAD (I did a color copy) e) EAD mailer (though is not mentioned in instructions, the mailer paper says that for making renewal faster, make a copy of it and send along with applciation...that's the reason I added it) 3) How to fill I-765: I mention here the important items only, rest are self-explanatory... column 10: Alien Registration Number (A-Number) or I-94 Number (if any): Give your A#, which should be same on receipt notices of I-485,I-131,I-765 and EAD column 11: Have you ever before applied for employment authorization from USCIS? select yes for this and in the next column write either Nebraska/texas service center and receipt date of old I-765 application column 14. Manner of Last Entry (Visitor, Student, etc.)--->if you entered on H1, fill-- H1B column 15. Current Immigration Status (Visitor, Student, etc.)-->AOS pending column 16. Go to Part 2 of the Instructions, Eligibility Categories. In the space below, place the letter and number of the category you selected from the instructions (For example, (a)(8), (c)(17)(iii), etc.). --->fill c 9--> all pending 485 candidates would fall under 9 c. column17: you don;t have to fill it.

Jkm:never go for info pass (infopass.uscis.gov/) unless you have time and live near a USCIS field office. waste of time,money and gas. its better to call customer support than infopass.
Most of the time the IO's are rude and won;t share info, but some times, may be by fluke, it's useful, that's what people are trying for...leaving no stone unturned in search of holy grail....for people like us, who work next to the field office, it's OK, I guess...

Just want to elaborate for those who do not know... There are basically 3 parts to background check viz...FBI finger print check, IBIS Name check and FBI name check... The first 2 take very little time and are usually complete in a week, 3rd check takes time and it's this one people are stuck for years... With this memo, an I-485 can be approved even when the 3rd part of the background check, the FBI name check, is pending, but first 2 checks need to be cleared as before... There are people who are waiting for 485 approval for more than 2 years, inspite of having current date all along...PD being current is a necessary condition and not sufficient...there is no guarantee that your application would be touched once your priority date becomes current... Unlike I-140... I-765, the application for EAD can be filed on your own, lawyer is not necessary...I did my renewal recently...I did not apply online, as I don;t want to go for finger printing and people seem to be confused about one check box in the online fillable form and there is also a rumour that paper filed application gets faster approval...based on all this stuff, I did a paper renewal on my own... USCIS will decide whether to renew an EAD for either a one or two year validity period based on the most recent Department of State Visa Bulletin available...I guess the bulletin is looked at the time of EAD approval and if your PD is current , then will issue 1 year EAD, else a 2 year EAD...in the actual wording it says 2 year validity of EAD is subjected to availability of a visa number, and I am interpreting it to mean PD being current in the most recent bulletin, not the bulletin that's affective at the time of approval... Here is some more info you may be interested in: 1) if you are not working on EAD, renewal of EAD is not essential. 2) You can not apply for renewal before 120 days of current ead expiration...this is a new rule came out this year... 3) Even if 90 days passed since you applied for renewal, you can not get the interim EAD from field office, they have discontinued this procedure long back... 4) 90-day time frame decision rule for EAD has to be followed by INS... 5) If you are working on EAD, you need to get the renewal before the current EAD expiration, you can not work on a receipt of I-765 application...it's illegal to work on a pending EAD application...Even if your employer and you agree to work together on a pending EAD, it still amounts to violation of immigration law...

hi Guys, I need some info : 1) I am on EB2. Labour date is Feb'2007. I got my I-140.I applied my I-485 in July 2007.I got my EAD also in october'2008. Now what would be next steps. Ideally speaking...according to letter...they should look at the cases according to RD and if an application has a priority date and visa number available should be approved and the rest of applications which are looked at but have no priority dates should be pending... INS is the most chaotic system...what they are doing these days, they are picking the applications which have priority dates according to the visa bulletin in effect and working on those picked cases, that's why getting your case picked and assigned to an IO is the most important move int he process....what this means is an application with an earlier priority date, but filed late and has a later RD, is preferred to a 485 application that's filed earlier but do not have a priority date... You look at it from any angle...the sense I get is, at least based on the approvals I looked at in trackitt, the approval trend is more towards an application that has priority date than the one that's filed earlier... In your case it would be beneficial if the priority date moves faster than the processing date...simply because I beleive a case, once on an IO's table take less than 14 days... It's my belief that once a 485 is assigned to an IO, it takes less than 14 days for an approval or request for further evidence or to assign it for further review... The bulletin that just came out today is Aug 2008 bulletin, which is effective from Aug 1st till 31st...they give it out 15-20 days in advance, so that Consular processing candidates and those who are applying for 485 get enough time for preparation.... So from Aug 1st till 31 st,for EB2, the cut -off date is June 1st, 2006 and your PD is July 28th 2006...According to the memo sent out to field officers and info given to media, they are touching even the applications which may not have priority date now, but are close to the current priority date...this they are doing to make sure they have enough applications pre-adjudicated, so that immediately up on availability of visa number, it can be assigned one and thus avoid waste of visa numbers...hopefully your application would be looked at by someone.... if they give a processing date of July 27th 2008, it does mean that they have not looked at any 485 applications filed after July 27th, 2008...what it means is most of the 485 cases, which have a priority date available(this is very important),applied before July 27th, 2008 are at least given one quick scan by an IO... Other wise what happens is, it will take to you to a customer service representative who will announce themselves like this--'Hi my name is Rebecca Reiner, i am your cs today and my ID no is#######, how may I help you today' ---it's waste of time talking to them, first they do not have access to vital info on your case, second to cover their inability, they will throw junk at you to confuse you further... My RD (date I applied 485) is Aug 2007 and the current processing date is July 28 2007 (Nebraska Center)... how do these three correlate? Here are the 3 vital dates I am extracting from the data you provided, and you need to think of one more date, Visa bulletin Date for EB-based Eb3. PD=priority date or the date labor was applied=Aug 17, 2005 VB cut off for EB3 for the month of July,2008= Unavailable RD=retrogression date or date on which 485 was applied=June 14,2007 Processing Date=the date published in processing date bulletin=July 17th, 2007 Here is what's likely happening with your case:Your application was sent on June and they would sent you receipts of the application and initiate the 3 different background checks, out of which 2 checks take less than 2 days...most probably your 3rd namecheck would be pending ...and since your priority date (Aug 17,2007) is not current according to July 2008 visa bulletin (Unavailable for Eb3 means, no Eb3 application can be approved), your application would not be touched till either INS personnel doesn;t have any work or your priority date gets closer to what is published in visa bulletin... If you are lucky, this might be happening as well: Here is the other scenario, all background checks are cleared and somehow your application is looked at and they wanted some more info, say on medicals or birth certificates...then they will issue an RFE...you would reply to it and they will update the info that they received reply from you...at this point there is some movement in your case and some processing was complete...but you would still be waiting for your priority date to be current in Visa bulletin, because with out meeting this requirement, you can not be assigned an immigration visa number resulting in your 485 approval... Now think about this: You have your RD past 30 days of processing date...what does this buy you? nothing...absolutely nothing...since your PD is not current in visa bulletin for July and even if your 485 is pre-adjudicated, you can not be approved.... But is there any benefit of RD being 30 days past the processing date? I don;t think so...the max you can do is take an appointment at a field office and try to get some info on your case, to see in what queue it is at.... The same appointment you can take and talk to an IO, even when you do not have your RD past the processing date... Once you are at the field office, whether an IO talks to you or not...depends on your luck... The moral of the post is: it does not matter if your RD is past 30 days of processing date or not, but for an IO to approve your case, your PD has to be current in the Visa Bulletin...

Getting the info from an IO, these days, may no be very vital, after the name check memo passed recently... But at one point if your processing date has passed month, then people used to go to field offices and usually it was the namecheck obstacle... There are several ways to get info or expedite process of namecheck...like writing to FBI, congressmen, ombudsman etc...there were indeed some really good results and name check got cleared...since name check was the only obstacle, they cleared 485...there were even of writs of mandamus against INS... PD=Priority date=The date you filed your Labor applicaion--this is the date checked against the date in visa bulletin...This has to be available to you at the time of applying the 485 and at the time of approval of 485 RD=Retrogression Date=The date you filed your 485 application---this is the date checked against the date in processing dates excel sheet...this is more of a guide line and if RD>processing date+30 days, you have better chances of getting info from IO, who may or may not be willing to talk to you... Doesn't matter...any of the 5 categories in employment based 485 is treated the same, when it comes to determining when the 485 was applied by an AOS aspirant...the major source of confusion is you are thinking that once your 485 is applied before the processing date, your 485 must have been approved... I tell you, when a processing date is useful... Let's say a person A applied 485 in June 2007, who has priority date of Feb2004 Let's say a person B applied 485 in August 2007, who has priority date of Feb2004, as well... Since the chances of an IO picking up the person A's application are more, if the Feb2004 is a current date at the time the IO looks the application, person A gets approved.... Let's say after a month another IO looks person B's 485 application, then by sheer bad luck at that point the bulletin shows a priority date of Dec 2003, then person B can;t get approved... Though both have same priority date of Feb 2004, because of 2 months difference in the 485 filing date, person B usually gets the approval later... 1) To apply for 485: Having your PD currrent in visa bulletin is sufficient, once your labor is certified. 2) To get 485 approved: Once you applied 485, it's not just the processing date(which is the second link you provided in your first post), but the priority date, as well, given out in the bulletin when your application is looked at, is at play... a): Regarding the processing date...the guideline is established that 485 is first come first process approach...but in spirit, the IOs are pulling up those 485 applications that have priority date, off late... b): Visa bulletin is important for 485 approval, because the IO can request an immigration visa number from DOS and assign it to you and approve 485, if and only if your priority date is current...I haven;t gne to that link you provided, but those people might be discussing this... many a time condition a) is not followed but condition b) is absolutely followed as the immigrant visa number has to be given by another department... We can say that condition b needs to be met absolutely while condition a is only for guide lines and not a necessary condition.... Anyway these conditions are necessary, but not sufficient for a 485 approval...

The link for processing timings with various service centers is correct...but there is no guarantee that a process is followed here....Very very rough area...You can use POJ method and try to reach an Immigration officer and get insights into your case, if your case is 30 days outside the 485 processing date and if your priority date is current. If you can;t get your case info on phone from an IO, which usually is the case, you can take an infopass appointment, even if your priority date is not currrent you can take an infopass, and go to the nearest field office.... There again, just like on the phone, the IO may or may not be willing to discuss your case...there are many cases where a trip to field office often results into nothing...
