Mr. CryActor CA: Who is trying to take the advantage HD: You or who is not crying. CA is trying to take the advantage of a pre existing damage on you. If there is a dispute without any proof, the guy who had the damage in their front would be found responsible if the other guy didnt have any damage on his front part of the car.(benefit of doubt) On the other hand, please note that CA had a recent accident and still to be fixed. What it may be true is that he must be showing that damage on you. Also good pictures of your car that you have taken are the proof of no issue on you. I was a victim of the so called BENEFIT of DOUBT once. There are two cars in the middle of the road which got into accident already and they are checking their cars. I was coming in the same lane and there is an evening sun light directly into my eyes, I didnt notice the cars are stopped, thought that they are moving.. and went with usual speed and noticed last minute and stopped real hard but still kissed the guy in front of me real mild(my car front air vent grill slightly broken but not noticiable) but the guy in front of me got a U-Haul knob(the stainless steel metal knob poking out of the car bumper). His vehicle was not at all damaged from rear due to my car hit. But at the end the guys(who had already into the accident before I killed the car behind of two), got on to my insurance (since it was summed up to a three car accident while I am being the rear guy of three). So, benefit of doubt is the guy who had the damage on his front. Dont be panic of your case. Tell him that you will take him to the court for the false allegation and sue him for the false allegation and court fees etc. If I am trying to be smart like him, I will back off. If not have fun with him by pulling him to the court and charging him all your court expenses, salary loss due to this case, time loss etc. | ||
