If no major damage to car, no need to call cops. Yes, call her insurance and tell them that she accepted that she was at fault and gave you her insurance information. Tell them that you have physical discomfort and need to see a doc. Even if you feel it may be psychological, you need to have a record to tie it to accident if it turns out otherwise six months or a year down the line. Check with your daughter again, make sure she is absolutely fine. | ||

Its a different story if it happens in parking lot. But, if it happens on main street, fault is clearly on the person who hit from back with a reason "Unable to maintain safe distance". Its a common rule across states in USA. | ||

1. Make sure all occupants of the vehicle are okay. If damage to car is major, call the police right away. It is not at all a major damage. No dents. She hit my car's rear bumper straight away. So there are two holes only. That too my car is old(1999). 2. Get other driver's car information (Make/Model/Color/Plate Number). She gave me her insurance information. 3. Get other driver's insurance information and contact information. She gave me that too. 4. Get any witnesses names and contact numbers. This is almost a must if the fault is with the other driver. If no witnesses and no police complaint, other driver's insurance company may say it is not their driver's fault. As she gave me her insurance information, I thought she accepted her fault. 5. Take pictures of the scene with your phone camera. I didn't do. 6. Call other driver's insurance and file a claim right away. If any physical discomfort exists, inform the insurance company that as well. I have to call her insurance. I surely feel discomfort at my back and left knee. I am not sure if it is real or pshychological. | ||

For such accidents...cops usually say as petty accidents similar to parking lot accidents...if you get the other party's insurance number that should be sufficient... | ||

At first I thought that there was no damage. Then when I saw it clearly, then there were to holes on my rear bumper. She gave me her insurance card. I thought that was enough. I am in work. I don't know how long it would take for this process. From all your posts, I thought I made a mistake of not calling cops. Now what to do? | ||

You should have called cops. Hitting from back is clearly her problem. Do you have her insurance policy number? call her insurance company, and register a complaint first and tell them that you are having back pain and you are on your way to hospital. tarvata sangati tarvata. | ||

First thing first, please check with a doctor about your back pain. I hope it is not serious, but sometimes hairline fractures untey complications later. Did you report this to cops? If no, do it asap. Why did you not call cops at the incident. In my opinion car dent kantey body dent is very bad. If you are all fine then it is up to you to pursue the case. Chinna dents ki repair might not be worth it. You can get compensation for the dents from the lady and leave it unrepaired. Also check with daugther if she feels 10000 % good.
