A special court here on Wednesday convicted Maya Kodnani, a BJP MLA and âformer minister in the Narendra Modi government, and 31 others, in one of the worst massacres during the 2002 post-Godhra riots, in which 95 people including children and women were killed.

Additional principal judge Jyotsna Yagnik held Kodnani and Bajrang Dal activist Babu Bajrangi guilty of murder under Section 302 of the Indian Penal Code (IPC) and criminal conspiracy under Section 120B of the Code. The court let off 29 of the accused in the Naroda-Patiya massacre case.

The quantum of sentence will be delivered on Friday. During the arguments on the quantum of sentence in the court, Special Public Prosecutor Akhil Desai demanded that all the convicts be given the death penalty, arguing that the case was fit to be treated as ârarest of the rareâ. Shamshad Pathan, advocate for victims said, âThe quantum of punishment under these two sections of the IPC means death sentence or life imprisonment.â

On February 28, 2002 during the Gujarat bandh call given by the Vishwa Hindu Parishad (VHP) to protest against the Godhra carnage a day earlier, a mob attacked Naroda Patiya locality on the outskirts of Ahmedabad, killing 95 people, and causing grievous injuries to 33. Kodnani and Bajrangi were accused of leading the mob.
Kodnani, 57, broke down as the verdict was delivered.

One of the accused, Suresh alias Richard Chara, was also convicted for rape. The court also convicted several of the accused on charges of rioting, arson, unlawful assembly and causing hurt with weapons.

The conviction of Kodnani, believed to be close to Chief Minister Narendra Modi, has come as a major embarrassment to the BJP with elections to the Gujarat Assembly due this year. The practising doctor was given the ticket for the December 2002 elections despite Patiya victims alleging her role in the pogrom. She again contested and won the polls in 2007 and this time after her victory was elevated and given a ministerial berth.

She was dropped from the ministry only after the Supreme court-appointed SIT arrested her in 2009.

The case was first investigated by the Gujarat Police, but in 2009, the Supreme Court appointed a Special Investigation Team (SIT) to probe 10 cases, including the Naroda Patiya carnage.

The SIT registered cases against many of the accused, including Kodnani who was then minister for women and child development. Kodnani was the MLA from the area. Witnesses in Naroda Patiya have made statements alleging that Kodnani had incited mobs. Bajrangi was accused of leading the mob that attacked the victims.

One of the accused was also found guilty of rape.

The court examined 327 witnesses. Of the 64 people accused in the case, three died during trial. The remaining 61 accused were tried for murder, arson and rioting. Most of them were out on bail.

Reacting to the verdict government spokesperson Jaynarayan Vyas said, âWe have not yet studied the fine print of the judgement. Once that is done and legal opinion is obtained, the government will form its opinion.â Dismissing allegations that the conviction of Kodnani indicated the invonvement of the state government in the riots, Vyas said Kodnani was not a minister at the time of the incident and ceased to be a minister when was arrested in 2009.

Welcoming the judgement, activist Teesta Setalvad said, âTruth has won and the real culprits have been punished because of the courage that the witnesses have shown during the process of trial.`
