Satya Dev Tripuraneni, who worked as an accounts manager at the California office of Infosys, filed the lawsuit in the U.S. District Court for the Northern District of California on Aug. 2. Mr. Tripuraneni alleges the company's management retaliated against him for blowing the whistle on the visa practices that Infosys followed, such as using short-term business-visit visas to circumvent the fewer and expensive work visas meant for high-skilled labor, according to a copy of the lawsuit. Mr. Tripuraneni couldn't be immediately reached for comment. Outsourcing-services companies like Bangalore-based Infosys carry out most of their work from low-cost locations such as India, but also send employees to client sites, mostly in the U.S. and Europe, to carry out technology projects. "Shortly after Mr. Tripuraneni filed his complaint with the Infosys whistleblower team, as per our policy, the company launched a comprehensive investigation of his allegations," Infosys said in a statement. The Nasdaq- and Mumbai-listed company said the investigation is continuing, and declined comment on legal procedures. The latest lawsuit against Infosys follows a similar one filed last year in the Alabama state court by a principal consultant, Jack Palmer. Mr. Palmer's suit led to an investigation by U.S. authorities, including an inquiry by a Senate subcommittee. Infosys has denied any wrongdoing in relation to the earlier lawsuit. The Palmer case is set to go for trial on Aug. 20 after an effort to settle it out of court failed last month. On Wednesday, Sen. Charles Grassley, the ranking Republican on the Senate Judiciary Committee, wrote to the attorney general of the U.S. Department of Justice Eric Holder, Secretary of State Hillary Clinton and Secretary of Homeland Security Janet Napolitano to inquire about the status of the government's investigation against Infosys in the Palmer case. Sen. Grassley also sought an update from the government on its efforts to investigate the abuse of short-term U.S. visa programs. The latest lawsuit against Infosys comes at a time when India's outsourcing companies are under intense backlash for sending business offshore ahead of the U.S. presidential election in November. Job creation has emerged as a key issue in campaigning as the U.S. grapples with a stubbornly high rate of unemployment and slow economic growth. In response, most Indian outsourcing companies have stepped up hiring in the U.S., tying up with local universities to groom potential employees. Last month, Infosys said it will hire 2,000 staff in the U.S. this year. |
