Team develops new alternative to narco-analysis, brain mapping Swapna Tarafdar New Delhi, July 13 (PTI) As the country debates on the validity of narco-analysis and brain mapping tests, forensic experts now claimed that a new technology 'Brain Electrical Oscillation Signature (BEOS)' is more "efficient and non-invasive" than the current scientific methods followed in the investigation of criminal cases. "BEOS can read the reactions of brain even if the suspect remains silent. It can pin-point the actual person present in the crime scene among many suspects which both narco-analysis and brain mapping cannot do," Mukundan C R, consultant to the Directorate of Forensic Sciences told PTI. Mukundan, who is the brain behind the new technology, said BEOS has already been appreciated by the British Psychological Society and the Society wants to have a "collaboration with us and have asked us to set up a lab there to carry out more research." He said narco-analysis test and brain mapping has been discarded by almost all investigating agencies in different parts of the world as they do not give "concrete results". "In narco-analysis test, the respondent blows out five per cent sense and 95 per cent non-sense. Under the influence of drugs, he speaks out even what he has not done but had wished to do. If a person consents to take a polygraph test to establish one’s innocence, the National Human Rights Commission guidelines pertaining to this would have to be observed, the court said. Similar guidelines need to be adopted for narco analysis and brain mapping, the court said. thank u rock } | ||

No narcoanalysis test without consent, says SC Dhananjay Mahapatra, TNN May 5, 2010, 11.07am IST NEW DELHI: In a major blow to investigating agencies, the Supreme Court on Wednesday declared as "illegal" use of narcoanalysis, brainmapping and polygraph tests on suspects.} Narco, polygraph or brainmapping tests cannot be conducted on any person, whether an accused or a suspect, without their consent, the SC's judgement said. We are of the considered opinion that no individual can be forced and subjected to such techniques involuntarily, and by doing so it amounts to unwarranted intrusion of personal liberty," a bench headed by Chief Justice K G Balakrishnan said. The apex court said that involuntarily subjecting an accused, a suspect or a witness to such techniques violates Article 20 (3) of the Constitution, which prohibits self-incrimination. Forcing an individual to such methods of investigation violates the scheme of legal process, it said, adding that even if such tests are taken voluntarily then also results cannot be used as evidence unless corroborated by other evidence. However, the bench also comprising Justices R V Raveendran and Dalveer Bhandari said if anything obtained by the investigators from such techniques in which a person had volunteered, the agencies can use them for further probe. The court further observed that in conducting the polygraphy test, the investigating agencies have to follow strictly the guidelines laid down by the National Human Rights Commission (NHRC). The apex court had on January 25, 2008 reserved its order on a batch of petitions challenging investigation techniques like brain mapping, lie detection and narcoanalysis as being illegal and unconstitutional, especially in cases where accused are opposed to them. The judgement assumes significance as the investigating agencies have been using narcoanalysis, brain-mapping and polygraph tests in a number of high-profile cases involving fake stamp paper kingpin Abdul Karim Telgi, Nithari killings accused, Arushi murder case suspects as well as parents of the teenager. | ||

USA/INDIA/RUSSIA all use it and its safe process its not water baording  What is "Narco Test"? Is it possible to lie during the Narco test? In a Narco test the subject is administered a fixed quantity of Sodium Pentothal or Sodium Amytal which puts him/her in a state of Hypnotism. Such a test is generally conducted on a suspect who is not coming out with the truth. Once put to this test he is half sleep and answers the questions truthfully. Mr Telgi was also put to this test wherein he came out with the truth and named big politicians who were the benficiaries of the Stamp Scam. However this test can not be taken as an evidence in a court of law. But certainly it helps proceed in the right direction and collect evidence which can form the basis for prosecution in a court of law. It is not possible for the subject to lie when administered the dose.
