The sum and substance of Y.S. Jagan Mohan Reddy's case is transfer of state resources to private ownership — land, minerals, water, power, hard cash and so on. Such transfers took place in earlier regimes also, but they were small in size and quantity. During Y.S. Rajasekhar Reddy's regime, this happened on a scale that no other state government in the country could imagine — thousands of acres of land, minerals, water and other resources thereof. Thousands of crores of state money was also transferred to private ownership through various means. His own family seems to have been the biggest beneficiary. The recent CBI investigations, arrests and court cases do not indicate that the state (Central and provincial) has acquired moral repositioning or is retrieving it from its fall. The moral and ethical ability of the state has come to a state of collapse. Chains of the state’s machinery were involved in this brutal abuse of the state power. These are not cases of simple corruption. Related Articles When Proudhon, the French philosopher, said that “Property is Theft” we did not understand what he actually meant. He definitely did not mean “property is exploitation”. What happened in Andhra Pradesh during YSR’s rule as chief minister, was not the continuation of capitalist/feudal exploitation. That was always there. The agencies that handled power innovated mechanisms that indulged in acts that are way above mere exploitation. This was the kind of theft that Proudhon was talking about. The agencies that were ruling AP plundered its very resources. Because of the internal contradictions of the ruling classes/castes (in this case Reddys and Kammas) the state institutions started reworking. Jagan Mohan Reddy is trying to defend himself by taking cover under the allegation that excessive media coverage is the enemy. The democratic state institutions have two agencies to turn to: the masses (through elections) and the judiciary. What kind of ethics will the electorate display in these by-elections and also in 2014 general elections, is one question. How will the judiciary handle these cases of theft is another question. The judiciary must work with this unusual context in mind. These are cases that robbed the state of its very legitimacy. The Cabinet, the Secretariat, the lower institutional norms were rendered immoral and unethical. Thousands of acres of land of mining, quarrying, ports were allotted for kickbacks. Projects were promised without Detailed Project Reports. Canals had been dug without constructing a dam for storage of water. Mobilisation money was released with an understanding of huge per cent kickback. Even the remaining contract money was meant to make property as theft. We normally think that exploitation (through payment of low wages) is immoral. In this case, even theft has been treated as morally and ethically valid. The issue here is brazen robbery with impunity. In this process the beneficiary families are many. They are connected to all spheres of institutional life. The judicial discourse and decisions, therefore, should focus on restoring the ethical and moral fabric of the state itself.
