HYDERABAD: The summons served on Kadapa MP YS Jaganmohan Reddy by the Enforcement Directorate (ED) asking him to be present at its Delhi office on May 31 stands to become invalid as the accused is in jail and cannot comply with the order issued under the prevention of money laundering Act (PMLA).

Moreover, ED's summons issued to the managing director of Jagati publications, too, would become redundant since the firm has no post of an MD.

Officials who went to serve the summons asking the Jagati MD to be present at the ED office on June 5 realised that they would have to come back after modifying the summons.

Although they did end up serving the summons on the Jagati company secretary, according to sources, these cannot be followed up through representatives.

Delhi ED authorities are now in the process of identifying the proceeds from the irregularities following which they will proceed to attach assets under the provisions of the PMLA.

Earlier, ED officials recorded the statement of Vanpic promoter Nimmagadda Prasad along with several other investors in Jagan's firms. Jagan auditor Vijay Sai Reddy's statement, too, was recorded by the authorities.

The ED officials are now looking to record the statements of all the arrested accused in the mining and Emaar scam cases and the Jagan assets case.

Since the accused like BP Acharya, KV Brahmananda Reddy, Y Srilakshmi, VD Rajagopal, Koneru Prasad and BV Srinivasa Reddy are in jail, ED is seeking permission of the court to record their statements.

The court will hear ED's views in the matter along with the objections of the accused on June 5.

Taking cognizance of the third charge-sheet recently filed by CBI in the disproportionate assets case against Kadapa MP Y.S. Jaganmohan Reddy, the trial court issued orders on Wednesday seeking his appearance along with five others accused on June 11.


They are his financial advisor V. Vijay Sai Reddy, Jagati Publications, Ramky group chairman A. Ayodhya Rami Reddy, Srikakulam Collector G. Venkat Ram Reddy and Ramky Pharma City (India) Limited (RPCIL).


The court ordered summons to all of them except Mr. Jagan, who was directed to be produced on prisoners transit warrant, as he is in jail,


Incidentally, the appearance of Mr. Jagan in court on that day will coincide with the expiry of his judicial remand. The court had fixed the same day for his appearance in the second charge-sheet.


The court rejected CBI's proposal to book Mr. Venkat Ram Reddy, an IAS officer, under provisions of Prevention of Corruption Act as the agency had not got the sanction of the government to prosecute him.


The legislation was, however, invoked against Mr. Jagan and Jagati Publications owned by him. Mr. Venkat Ram Reddy was permitted to be tried under provisions of IPC, mainly Section 409 for ‘criminal breach of trust'.


As vice-chairman of Visakhapatnam Urban Development Authority (VUDA) in 2005, Mr. Venkat Ram Reddy was charged with approving the layout plan of Ramky Pharma for setting up a special economic zone at Visakhapatnam by circumventing the guidelines of the master plan.


Quid-pro-quo deal


Mr. Jagan's father and late Chief Minister YSR prevailed upon Mr. Venkat Ram Reddy to approve the layout. As a quid-pro-quo deal, Mr. Ayodhya Rami Reddy ensured circuitous investment of Rs. 10 crore in Jagati Publications though two companies – TWC and ERES which were represented by his own men. The third charge-sheet, which was devoted to the role of RPCIL in the case against Mr. Jagan, said that the company was given relaxation in the matter of ensuring green belt area as per norms of VUDA. Against the required 250 metres, the company was allowed to lay the belt only up to 50 metres. The land saved thus was plotted and sold by the company for Rs. 133 crore.


In the FIR earlier, the CBI had said the company was allotted valuable housing board land at Gachibowli and given relaxation of stamp duty and registration fee for its township project at Maheswaram here. The duty was also relaxed for RPCIL.
