I was in the same boat mav baa...naaku 6th yr lo labor apply chesaaru..After labor approval, I had to immediately file i-140 in premium...mee vaadni I-140 premium lo apply cheyinchamanu vaadi company tho...he will get approval in 3 weeks...this is same like H1 premium where they charge 1k more...then he can file for H1 extension once 140 is approved... | ||

Ok. Intiki poyi choosta. One of the poster says: He used previous PD and got GC approved. He says his case was lucky as he didnt come under AC-21 act as he did not apply 485 thru his previous employer. Question is - If you apply 140 and is approved and dont apply 485, move on to new employer then apparently you cannot use previous PD anta.. deenemma.. idemi logic? itiki velli choodu..there is a lot of confusion about this..uscis has changed its words many times..but recent ga april 12 na edo teleconference with nebraska center that u can carry fwd the pd unless the 140 is revoked because of fraud Who is this DB member? | ||

I am reading a case on trackitt: I applied MTR twice and both were denied . Looks like it just goes to the same adjudicator which does not make sense to me. I then contacted the ombudsman office and got the same reason from USCIS that the PD cannot be ported when the I-140 is revoked (withdrawn by the employer). I did consult with Murthy law firm and they said I could reapply I-485 and try again. I dont know what my next step should be. THis is very frustrating as it seems it works for some and doesnt for some... My new PD is 2008. Has your lawyer given any suggestions? Is this true that PD cannot be ported when I140 is revoked??
