At last, senior IAS officer B P Acharya has managed to get the bail in connection with the Emaar Properties case in Hyderabad, thanks to the cooperation from the IAS lobby and the Kiran Kumar Reddy government.

The CBI special court on Friday granted bail to Acharya on a personal bond of Rs 25,000 as the CBI has failed to secure permission from the Centre for prosecution of the IAS officer.

The CBI has to obtain permission from the Department of Personnel and Training at the Centre for prosecuting the IAS officer, as it is essential for the agency to obtain Central sanction under section 19 of the Prevention of Corruption Act to prosecute officials who have been booked under the Act.

However, it has been more than a month and a half since Acharya has been in jail, yet the CBI has not been able to get permission from the Centre for their prosecution despite its repeated requests.

The CBI court had warned last week itself that if the CBI failed to obtain permission, the court would not hesitate to discharge Acharya in the Emaar scam.

Inquiries revealed that the CBI had directly written to the Centre seeking permission to prosecute the IAS officers, while it was mandatory for the agency to first take the state government's approval before approaching the Centre. The CBI argued that the IAS lobby in the state government was deliberately trying to delay granting approval for prosecution of the tainted bureaucrats.

That is why we have written directly to the Centre seeking permission. But the Centre wants the request to be routed through the State government; which is why there is a delay, sources added.
