you have ticket evidence, take printouts of outgoing calls to rental office prior to that trip..... take printout of the call u made to apartment person on the day u was there to sign papers.................make a timeline story and file a case in small claims court.... it wont harm either initially.....they will call for arbitration first....by that time the apartment should let u go without paying for so called break | ||

ee Apt people tho kastam.. 1. Are you on Month to Month from Oct? Do you have any letter saying that? OR did you sign any letter , accepting month to month lease. 2. A Signed letter will be sufficient for notice. You should put all these evidance in a paper and write a letter and attest with a Notary and mail them with Acknowledgement. By seeing Notary letter , they will think...and you can start bargaining. | ||

ple help me guys...here is the story: I lived in an apt in TX, My lease ended in September 2011, And I was on month to month basis from October 2011.I was staying in NJ and I thought of moving out from the above mentioned apartments in TX. I started calling from November 25th,to letting apartment mgmt know that I would move out by the end of December 2011. The apartment mgmt insisted on filling out move out notice in the apartment office itself, even though I requested them many times to send it to me either as email attachment or Fax.Apartment management finally said there is no other way except come over to TX and sign the move out. Finally I decided to fly TX to sign the lease move out document. Before I go over there I asked them, if they are open on Friday Dec 23rd 2011, which is the date possible for me to go over there, and Apartment mgmt said They were open. So I booked a flight ticket from nj San Antonio and booked a rental car there. To My surprise I see no staff in the apartment office. At the same time I found some water leakage in apt so I called apartment emergency number, and left a voice mail. After couple of hours, some one replied me, and I told her that I flew from nj to sign move out notice but no one was there in apartment office. She said they were closed on that day. Since I had return flight next day (24th Dec 2011) I told her that I have to have some one in apartment office to sign the move out document. She said I could write a letter myself showing that I was moving out and sign it, drop it off along with keys in the apartment drop box. I did exactly what she said. After a week I called apartment manager 2 times and asked whether everything is fine regarding move out. she said everything is fine. Now they sent me a rental due of $593.81, and also apartment staff is saying that my lease with them was broke, and also asking me to pay for the lease break $950 (approx). First of all, I have no mistake from my side, The apartment management misinformed me that they were open on Friday 23rd Dec, that is the reason I went over there to sign the move out notice. In rental agreement there is ONLY indication of move out notice must be in writing, it does not matter whether I fill out in front of them or not. Also, If the staff Had not told me that I could make up my own letter, I would have stayed couple of more days and sign it in the apartment office. Now the apartment staff argues that person who told me on phone, no longer work with them. But she was working at the time I dropped move out notice. It is their mistake that they trained their staff in such a way. Emi cheyali???
