I have still 3 more years of h1b. so i-485 reject antu authey, we cant help. usa or india. we have to finallly return to india. >>> i know a friend, whose 485 was rejected due to some reasons in usa. He went through lawyer and got some letter from a senator and finally, his case was approved. If you are in India, there is NO WAY you can come back to usa, once 485 is rejected. but h1 period unnapudu, 485 cancell/suspend lo unte, i can still work on h1 . am i right>>> I am NOT sure on this one, But as far as I remember, once 485 rejected means, you should leave usa, irrespective of H1 period, unless you appeal. But i may be wrong here | ||

One thing... after LC approval... when filing for 140, then itself you have to declare if you want to opt Consular Processing or traditional 485 filing (not after 140 approval). | ||

Consular Processing method lo you will have to goto your home town and to the nearest US Consulate and submit the same paperwork as you do in regular 485 process and then appear for an interview.
