Normal period for H1 is 6 years. With in the 6 years, regardless of GC stage, you can get an H1 extension. To get an H1 extension beyond 6 year limit, you have to use 21st century act. With 21st century act, a provision is made to extend the H1 beyond regular 6 year limit, 1 year at a time with a labor pending for at least 1 year or 3 year at a time with an approved I-140. Go ahead and apply for I-140 ASAP. If it gets approved you will get a 3 year extension beyond the current 1 year extension which will complete 6 year limt. If the I-140 remains pending by chance, you can get a 1 year extension as you already have an approved labor which will be 1 year old by that time. my cousin got labor and 140 approved from employer a, he has a fight with employer and decided to quit the company, now if he goes to compnay b and apply for labor and 140 can he have PD of company a labor | ||

Orthodox: I have approved LC. Now applying for 140. Say 140 not cleared by the time my H1 6yrs expiry: 1. Naturally I will apply for 1yr extention. 2. Mclovin, Scenario 1: You have 6 months left on H1. You apply for PERM now, say it gets cleared in a month and then you apply for I-140 (you don't need your date to be current to apply for this). Let's say I-140 gets cleared in 2 months, though least likely according to latest trend. So in 4 months you had your I-140 cleared and you have 2 more months on H1 left. Now based on your approved I-140, you can get a 3-year H1 extension beyond 6 year limit according to 21st century act. Scenario 2: Same scenario as above except that I-140 is pending. You apply now for PERM which gets cleared in 2 months as above but I-140 is pending as against approval in scenario 1. According to 21st century act provision, you can get 1 year extension beyond 6 year limit, if the labor is at least 1 year old or 3 year extension if I-140 is approved.
