look at the way these laws are drafted -

The offence is punishable with an imprisonment for a term which may extend to three years and with fine

it is allowed when they have proof against it. blind mud slinging is obviously not allowed. again, the degree varies. if someone simply shouts cbn is a useless fellow, that goes no where but if someone claims CBN as a corrupt CM amassed crores, and without proof, that is slander and that person should be pulled to court.

and to clear it, individual dignity is a human right. freedom of expression to me is also a human right but for various reasons, it has been put in our const as a fundamental right. same with freedom of religion. since you wanted to point out that ind dignity is not a fund right, technically, I said it is a no brainer human right.

fundamental rights are guaranteed in the const to protect your basic human rights. slander and libel come under violation of basic human rights. mere embarrassment or abuse does not come under defamation but written/published material that causes more than hurt feelings, tends to disrupt someone's family life and their social standing - is slander. if there's no law to protect me against that, I can resort to any means, like the salon shoot out in california. what would you prefer happened?

that sounds a bit extreme. whatever action is taken against, as long as it not going in the direction of govt interfering with fundamental rights, it would be limited to that individual case. even in case of retaliating with physical violence, i would say the person has to be prepared to face the consequences of that retaliation

a lot of times they go together. you would have to inspect every news and validate its credibility before releasing it to public. if you go on youtube and rant about someone that you cant prove and it gets 10 million views, are you being arrested for your rant or for the number of views ? is the court going to apologize to you if tomorrow it is proven that your rant was true ?
