HYDERABAD: After the Central Bureau of Investigation (CBI), the Enforcement Directorate is set to snare the accused in the Jagan assets and APIIC-Emaar land cases by bringing them to book under the Prevention of Money Laundering Act, under which the offences are mostly non-bailable in nature.
CBI sources said evidence of money laundering through foreign investments by the companies floated by Y S Jaganmohan Reddy have come to light during the two days of searches and that the ED will be roped in to pursue them in detail.
As per preliminary investigations, 2i Capital PCC and Pluri Emerging Co, two Mauritius-based companies, have invested in Sandur Power owned by Jagan. These two entities are described as Protected Cell Companies (PCC) which means as per the laws in Mauritius, they need not explain their investments to anybody.
However, the Securities Exchange Board of India (SEBI) had long ago banned the operations of the PCC companies in India on the grounds that they are being used to transfer unaccounted money into the country.
Some of the companies in the country are acting as conduits for the Mauritius companies to channelize the 'black money' back into the country for different businesses, claimed ED sources. "We are examining the violations under PMLA. After obtaining necessary evidence , we will move forward," the sources said. One alleged violation that is set to come under the ED scanner is that with the money that the two Mauritius-based companies pumped into Sandur Power, Jagan invested the same in his two media entities, Jagati Publications and Indira Television, operators of Sakshi newspaper and TV respectively . What the Enforce Directorate is set to probe is the charge that Jaganmohan Reddy invested more than 32 per cent in his two media companies from the money that came into Sandur Power.
"This would amount to a violation under Foreign Exchange Management Act (FEMA) as no foreign direct investment in the media sector in India can exceed 26 per cent as per the existing rules," said the sources. According to CBI sources, the ED will file a separate case under the PMLA in a day or two. At present , the ED officials are cross-checking the funds flow from the two Mauritius companies and recording their version as to the extent of their investments into Jagan companies, the added.
As of now, the accused in both the Jagan assets case and APIIC-Emaar case have been booked under the Prevention of Corrpution Act, and under various sections of the Indian penal code including fraud, entering into a conspiracy, falsification of accounts and criminal misappropriation.
