Did it get approved before her H1 filing? anedi imfortant point. Edi emainaa, USCIS ee gap ni pattadam kashtam unless they are as good as us  No matter hwat, finally she is out of status. if your H1 application reached USCIS before your OPT end date, you are eligible for cap-gap(b/w mar and oct in this case), you can stay and work legally during this period (again depends on immi official's decision) ... Deniki? Here the questionis dependent status not primary. Her status is acquired. So whatever her husband status is, she get it but not implicitly. He need to apply for that F2 or H4. Ikkada matter enti ante.. he changed his status from F1 to H1 but she still on F2. Since her husband is not on F1 nomo, she lost the status and now she her stay is 'Overstay' aka illegal stay. It depends , I got a call from INS and asked me what location You are working, I told them the place and INS person told me that I had no LCA to work in that client place, My reply was I was not aware of that , as my employer was the one who asked me to work at that place.. , and I moved to project very recently Later I asked my employer and said he applied for it , and I was fortuante as it was new project , may be they did not care | ||

she is legal from your description coz her F2 to H1B COS request had been filed in a "Timely" fashion...i.e. her COS request was filed when she was in valid status, so now her status is "pending" mostly she would receive approval with I-94 - no worries | ||

We applied for a change of status from F2 to H1B in April 2011 under 2012 quota. we received my receipt # on june 8th 2011.Mean while my (Raju) visa status changed to H1B from F1-opt on 27st of June 2011 and which makes her F2 status invalid. As we am already on change of status by then and because of last action rule we didn't apply for H4 status due to the uncertainty on the H1B application decision. Her H1B status was updated to request for evidence on august 4th 2011 and Yesterday her H1B filing lawyer asked us why we didn't apply for H4 along with Raju and we explained the same reason as above. She feels that this might create an issue in my H1B decision. Now my questions are 1) Is her stay in US legal as my COS to H1B is under process. If her stay is legal, how many days would it remain legal? 2) As per the rules, if we get a H1B visa it gets activated on Oct 1st. If her H1B gets approved before Oct 1st then would my stay become illegal from that point of time to Oct 1st as she would not hold any valid visa. Do she have to go back to India and get my H1B stamped in order to become legal? 3) What is like H1B approval and H1B approval with change of status?
