Hyderabad: Even as the CBI prepared to file an FIR against Jagan, there is speculation on whether the MP will be arrested. CBI officials are tightlipped about this, only confirming that cases will be filed against him at the earliest â may be as early as Friday. Cases will also be filed against representatives of companies that have invested their money in Jagan promoted enterprises in a quid pro quo.
âAfter filing the cases, we will go the whole hog into the investigation. The case requires multi-disciplinary investigating teams to get hold of crucial evidence and figure out what happened in entirety. There are many aspects to the investigations and will require help from many agenciesâ CBI sources said. Sources averred that though Jagan may not be arrested immediately, the chances of this happening pretty soon cannot be ruled out. This is because of the apprehension that Jagan may tamper with the evidence.
The corporate wing of CBI will take over the case to study the alleged âmoney laundering activityâ involved in raising investments for Jagati Publications, Indira Television, Janani Infrastructure, Carmel Asia and Sandoor Power.
Hawala transactions and income tax evasion will be examined by the corporate wing of CBI. The Enforcement Directorate (ED) is also sending a team to work along with CBI to unravel complex financial dealings involving dozens of companies. The cases to be filed against Jagan will be filed under different sections of the Indian Penal Code, Prevention of Corruption Act and Prevention of Money Laundering Act as directed by the court.
Out of three, the PML Act is more powerful and allows seizure of Jaganâs assets if charges are proved. The same Act was resorted to in the Ramalinga Raju case to attach more than 130 properties. But the procedures are lengthy. The ED will investigate the PMLA violations and submit a report to the CBI.
The CBI is carefully examining the HC order to finalise suitable sections under various Acts to file the FIR.
âAfter the FIR, the real work starts. We need to find out clear evidence that will stand the scrutiny of courts to frame the chargesheet.
This will take time,â said the sources. It is believed that the CBI is optimistic that it can conclude its investigations in two months after which the chargesheet can be filed.
The division Bench observed that companies floated by Jagan showed phenomenal growth, and the face value of the shares of some companies appreciated by as much as 35 times. It was at these escalated values that corporates invested in Jagan companies.
CBI sources said that for the first time in the country they may arrest those who have paid bribe. Till date only those who have taken the bribe were arrested, now in Jagan case those who have paid money for a quid pro quo arrangement also face action.
In case of IAS officers, CBI will write to Ministry of Personnel to give it the property returns submitted by them so that they could go ahead with investigation to find out known and unknown sources of income of the officers. Sources believe that the arrest of some high profile officers in the YSR Reddy regime and some industrialists is imminent.
