renduu avasaram...h1 ledaa I-140 choice choose chesukodam kaadu... 1) H1 is necessary for you to maintain non-immigrant status...whether you get 3 year extension based on 6 year limit stipulation or by showing I-140 approval is a different matter... To answer your question...when you apply for an h1 extension...lawyer mentions on what basis the client is eligible for H1 extension...there he mentions either 6 year limit eligibility or if the applicant crossed 6 year limit, he would attach the I-140 approval notice saying the applicant is eligible for 3 year extension according to 21st century act... 2) You should file I-140 and get approved to continue your GC process...this is for you to get GC ultimately and get converted to immigrant status...
My best guess is...using I-140 approval to get 3 year H1 extension is for those people who will cross 6 year limit if (current stay on h1+3 years)>6 years...and you don't fall in this scenario...so you should apply for a normal H1 extension and INS would approve till the end of 6 year limit date... I know why you are confused...In present situation labor gets approved in short period...if a person completes 6 years with out I-140 approval but with labor approved not earlier than one year, he can't get a 7th year extension... The bottom line is if you don't have I-140 approved, to get a 7th year extension your labor must be atleast one year old... The case I was talking about is labor approved which was filed more than an year ago,did not file I-140...the lawyer said I can;t get an extension, which was incorrect...see the memo below... I present verbatim from William Yates memo (http://www.murthaimmigration.com/wp-content/uploads/2007/08/ ac21_guidance_140485h1b.pdf ) ,the answer to our question, which tells me lawyer is incorrect... Question 6. Should service centers or district offices deny a request for an H-1B extension beyond the 6-year limit where the labor certification was filed over 365 days ago, has been approved, but the I-140/I-485 has not yet been filed? Answer: No. Until further guidance is published, a request for an H-1B extension beyond the 6-year limit should not be denied on the sole basis that an I-140 petition has not yet been filed.

INS is mess and beyond reasoning and don;t follow a system...a person's GC is more of a luck many a time... No one expected the bulletin to be current last june...it was a wrong move from INS to mint money...they will resort to these tactics quite often... Who ever had PERM certified around last June was eligible for 485, but those who never applied thinking that their turn would be long way were losers... Again,this year, there are some proposals to capture the unused immigrant visa numbers from previous years and also to abolish the per country quota limit stipulation...who knows, it can happen any time soon or may never happen...everything is gray with INS, neither concrete nor in black and white... That's why get your PERM certified and file your i-140 and get it approved and then wait for bulletin for your turn to file 485... GC with INS is not always First in first out queue....
