First one is very riksy. Even if client letter head and all, how will he get W2 for 2009 and past 6 months paystubs?

Option 2 is the only way. Apply for new H1 in prem and within a week he will get receipt and can start working. What worse could happen - at the max H1 will be rejected.. so what..

my wife was in the same boat mama....applying COS is the safest way..premium lo file cheyandi with project contract and stuff..it will be approved......

Naadi same case unde..my wife came on H4 here..but before that i have applied her H1 when she is in India so with out I-94..as soon as she landed here her H1 was approved in 2 weeks...so our attroney filed some form(i dont remeber the number) to change the status from H4 to H1...for that we didnt go out of country..

This will be the best

But I think Apply for COS and then still the old H1 can be used. but end of the day stamping is required for mobilty to go India for vacation

Ask ur freind to post in Murthy forum so that he/she can get professional advice

Here's is my friends situation...

He applied H1 for his fiancee in 2009 while she was India and she got her I797 approval which do not have a I-94 (so, she has to get stamped to start working on H1)

They got married in Jan 2010 and she came with him to US on H4 visa instead of H1 since she did not have a project then and he didnt want to get the H1 rejected.

Now she has got a project but the joining notice is only 2 weeks. Now his question is within 2 weeks what is the best option for him to get her to H1 status so, that she can start working.
