Update 04/07/2008: OPT Extension Rule Scheduled to be Published and Take Effect Tomorrow, 04/08/2008 * Effective date of this rule will be very crucial for the non-STEM OPTs in that 17-month extension is not available for them and the only way they can extend their OPT status during the cap-cap is to file H-1B petition before the annual cap is reached. Probably the chance for this option may not be too promising for regular cap filers but U.S. earned advanced degree cap filers may still have a time to file the H-1B petition without resorting to the special arrangement to fill the cap-gap. For these OPTs, simple filing of H-1B petition while they are in status and before the cap reaches will extend their OPT status filling the period of cap gap, provided that they are selected in the lottery and eventually their H-1B petition is approved. Please stay tuned to this website for potential USCIS release of further guidance for some of the issues which are tossed on the court of USCIS by USICE. Please remember that unlike the current regulation under which the DHS Secretary could have given a relief by just announcing such decision in the federal register to fill the cap gap, the new rule will allow extension of employment authorization during the period of cap gap which was not available in the current rule, which just assumed that the H-1B filers was in a period of lawful stay during the period of the cap gap without the employment authorization. | ||

It is somewhat unclear if the regulation would extend the total possible time on OPT to 17 months or if it would provide for an additional 17 months beyond the currently authorized 12 months, for a total of 29 months. It appears that the F-1 OPT will be valid for a total of 29 months. However, one must plan to file for the F-1 OPT before graduation, under existing procedures, until the regulation is published or until ICE issues a public notice, if one is to avoid losing out on the OPT altogether. It is unwise at this stage to wait for any potential changes. | ||

04/04/2008: OMB Approved OPT 17-Month Extension Rule!! * Dramatically, the OMB approved yesterday in "three days" USICE regulation to extend OPT for 17 months for certain qualified OPT F-1 aliens. Please stay tuned to this website. The extension does not take effect until the regulation is published in the federal register. It is anticipated that USICE will publish this rule as quickly as possible. We extend thanks, on behalf of the agonizying OPTs and their employers all over the country, to the Assistant Secretary of USICE, Director of USCIS, and most of all, the Secretary of Homeland Security and the White House.
