Ippudu kotta employer ki maarithe, within USA lo unte, neeku I797-A ostadi, with I94 attached. Petition approve ayyindi kaabatti, I797A ochhindi but since visa expiry avutundi kaabatti, you need a valid VISA to enter USA back again. VISA is to enter USA. I94 dates determine your legal stay. Dharkar di same employer, needi different employer. Employer maarina koddee, I94 expiration change avutoo untadi. Say, you were on employer A, for one year. Employer B ki maaraav. Appudu nee I797 petition approval meeda 3years ki saripadaa ostadi I94. Each H1 approval will give you 3 years until 6 years is consumed. Suppose, four years varaki oke employer deggara undi, change ayyaavu anuko, B employer ki.. appudu only 2 years ostadi. Naaku telisi, nee situation lo Extention avasaram ledu. Start your extension process atleast 6 months before your I94 expiry. Cost anedi it depends on ur consultant..full time employee aite valle choosukuntaru..you will get an extended petetion which u can use to stay in the country beyond sep 2008. after that if u have to leave the country, u need a stamp to come back. i suggest you start ur extension process now | ||

First: As MC said, the most important is to file H4 extension as well... 1) My employer applied extension 3 times so far, which included H4. First time premium and rest regular...first one came in a week..second in 4 months and third in 3 months...I would assume for regular processing of H1 , 3-5 months looks reasonable time... 2) The lawyer fee was 1500 for both applications (h1 and h4) excluding the INS fee (don;t know the amount)...my employer paid all money...both lawer and INS fee 3) Except in the first case, when I had a problem at DMV, the applications were sent in the last month of H1 expiration date...2nd time it was 2 days before expiration date...not that I did not want to file earlier...but you know how desi companies work... 4) There may be slight advantage in delaying the timing of the application, because in this case if there is a query and subsequent rejection...you can still enjoy some period of employment than in the case where you applied 4 months before the expiration date... Cost depends on Attorney fee, usually it takes 3 months to get an extension, u can file for an extension as early as 6 months before ur current H-1B expires. If u have changed employers i guess u will have to file an I-129 as well . Don't forget to file an H-4 extension if your spouse is on H-4, my frind landed in big trouble when he missed filing a H-4 extension | ||
