need not be true... Let's say the guy who applied for labor cert in 2001, got approved in July 2007, at which time he was eligible to apply.... Let's say the guy who applied labor in 2003, got approved in Jan2007, and he did apply I-485 in June 2007... The guy who started labor 2 years earlier applied I-485 one month late, because his labor approval was late.... Now let's say for both of them the dates are current.... Since later guy applied I-485 earlier, his 485 is ready for approval except for the availability of an immigrant visa number...as date become current he get 485 approved... Let's say the earlier date labor guy's 485 application processing took 2 more days than usual, by which date the visa number becomes unavailable...ika veedu mallee dekutaa untaadu.... INDIA EMPLOYMENT SECOND PREFERENCE VISA AVAILABILITY Section 202(a)(5) of the Immigration and Nationality Act provides that if total demand will be insufficient to use all available numbers in a particular Employment preference category in a calendar quarter, then the unused numbers may be made available without regard to the annual �per-country� limit. It has been determined that based on the current level of demand being received, primarily by Citizenship and Immigration Services Offices, there would be otherwise unused numbers in the Employment Second preference category. As a result, numbers have once again become available to the India Employment Second preference category. The rate of number use in the Employment Second preference category will continue to be monitored, and it may be necessary to make adjustments should the level of demand increase substantially.
