Already set chesaru. Seeing the downtrends regarding EB1C managers, however EB1B scholars are increasing in Indian Community, which is PHD and PATENT Holders Category. I know atleast two guys who are working agressively to get under EB1B, so far each one wrote 4 patents, if 2 more done, then it will be EB1B. | ||

Adhey lekka. HR1044 is not removing overall limit. Technically this bill is allowing a elastic cushion to EB categories. Whoever pulls the elastic will get more GC's, first preference to EB1 then EB2 then EB3. Overall ga EB3 is screwed royally and highly if HR1044 is passed. | ||

HR1044 bill basically " increases the per-country cap on family-based immigrant visas from 7% of the total number of such visas available that year to 15%, and eliminates the 7% cap for employment-based immigrant visas. It also removes an offset that reduced the number of visas for individuals from China" There are three limits, One is Family based GC which is 7%, Two is Employment GC which is 7% (2800 per category for EB1, EB2 and EB3) and third is overall GC, i.e. FB+EB 15% (i.e. 55K). This is written on every Visa Bulletin "2. Section 201 of the Immigration and Nationality Act (INA) sets an annual minimum family-sponsored preference limit of 226,000. The worldwide level for annual employment-based preference immigrants is at least 140,000. Section 202 prescribes that the per-country limit for preference immigrants is set at 7% of the total annual family-sponsored and employment-based preference limits, i.e., 25,620. The dependent area limit is set at 2%, or 7,320. 3. INA Section 203(e) provides that family-sponsored and employment-based preference visas be issued to eligible immigrants in the order in which a petition in behalf of each has been filed. Section 203(d) provides that spouses and children of preference immigrants are entitled to the same status, and the same order of consideration, if accompanying or following to join the principal. The visa prorating provisions of Section 202(e) apply to allocations for a foreign state or dependent area when visa demand exceeds the per-country limit. These provisions apply at present to the following oversubscribed chargeability areas: CHINA-mainland born, EL SALVADOR, GUATEMALA, HONDURAS, INDIA, MEXICO, PHILIPPINES, and VIETNAM." Untill Overall GC limit is either increased or removed no use of HR1044, further it will hurt EB2 and EB3 Indians. If you remove per coutry limit and let the over all limit exist then first EB1 gets preference and once EB1 India gets all GC's then EB2 India and EB3 INdia are royally screwed. Only solution is removing Diversity GC i.e. Lottery GC's and issuing them to EB category for 5 years or 10 years. Republicans passed this bill in 2012 and Dem senate did not take this bill. | ||
