assuming u r h1 is also expiring on dec 6 th, best case wait until h4 ead falls 180 days and file both we did that way but my case i waited 2 weeks only because it was closer. Are you saying... even when H1 candidate applies for transfer, his spouces old H4-EAD is valid? R U sure? Hypothetically, If we go with your logic... what happens if H1 is rejected? H4-EAD still valid? I thought H4-EAD is linked with H1 and if H1 transfers, a new H4-EAD must be applied to piggy back on the new H1. Please correct me if I am wrong. Jai Andhra!! No matter what h4 ead can not apply >180 days even if they apply they wont open case until the tile falls 120 days. Thanks brother, H1 extenion and H1 tranfer ki, H4 EAD ki link untundi ani naaku teliyadu. h1 transfer ki, H4 EAD kooda premium lo apply cheyachu ante, I will go with this option.Current H4 EAD is valid till 12/09/2019. H1 tranfer work ayi, H4 EAD kooda premium lo tondaraga approve ayithe nenu lucky annatu. Worst case lo, H4 EAD extension ki nenu pettina dabbulu ($400 attorny fee, and $500 USCIS fee), anni kalipi oka $1000 bokka ani anukovadame. | ||

most of the answers are wrong below. op question chudandi ayya. he is not applying for extension he is applying for transfer. now answer to the op wuestion: you can do either way. but you can apply premium to h4-ead only if u apply concurrently. but recently a new rule came (dont know when it is applicable) as per that h4-ead need finger prints and that delays the process because dinger print appointments itself takes time. so talk to your attorney.
