He is resigning here and going back.Has an offer with a Big 5 consulting company. His grouse is current company in US is asking him to pay the relocation amount. He says - you brought me here for a particular role and did not give that role to me. So I resigned - I should not pay. Plus is considering going to an attorney..."there is a huge difference in the job description given in the petition and the the actual work they have asked me to do" | ||

just 5 months ke no indian IT company will file GC.. L1 is not location specific...and it is a intra company transfer visa...so company can ask him to work in any location. | ||

L1A is managerial visa, adi teliyakundane solution designer la vocheda candidate? And L1A is inter company transfer visa so he can go back and resign... He cannot resign here without other visa Vi veri universum vivus vici | ||

Those of you who know this - Can you please throw some light? An ex colleague of mine from the top 3 Indian IT outsourcers came to US about 5 months back on L1A. The role - lead / Chief Architect for all US projects in a particular vertical + lead Pre Sales from Solution perspective i.e. as a Solution Design head for US. After he landed - he started complaining - his employer started body shopping with him because the big project for which he was brought did not materialze. Now he wants to resign & go back to India - GC not being filed as well. But employer wants him to pay back the relocation cost. Does he have a case to fight - because the job spec in L1A is different from the actual work he did in the last 5-6 months? |
