you will be eligible to get 7th year extension if 1) your I-140 is approved 2) Your perm is pending for more than 365 days If you start from scratch, For PERM it takes 3-4 months pre-processing (paper ads etc), 6 months for the Approval (no premium for perm). So 10 months for perm and I-140 (can be premium) takes around 10-11 months.. So get a new employer now and start the processing now. Make sure that the perm is applied atleast a day before you complete 5 years. In that way, even if there are delays in perm approval, you are covered for 7th year extension. Backup would be convert to H4 until I-140 is approved and get H1 based on I-140. But there will be lot of issues for this. So, go for an employer who start PERM now.. veni.. vidi.. vici..

Get an other job offer and start GC right away. or Find a desi employer start labor as future employee then start searching for a job as soon as u get a job move to him. Wife h1 irrelevant as u have to leave the country unless u file for labor in the next 1.5 yrs. |

Hello, I am with a desi MNC on H1B and promised to do GC in 4th year, Now they changed policy and no GC process for the employees. I got an offer but unfortunately transfer rejected after 2 RFEs. I have already completed 4.5 years, Can you please suggest whats the best options for me. My wife is on H1B and completed 2 years. |
