Thats correct. Latest approval overrides other approvals. But if the lawyer's request to cancel the latest approval gets approved, the previous 3 years approval technically holds good. But its a good practice to write a letter to USCIS that you are continue to be on the 3 years extension status AFTER the latest 1 years extension cancellation is approved. (since in the records of DOS/CBP, your I-94 date would be appearing, this needs to be reflecting your assumption, otherwise it will be a surprise at POE if you happen to travel outside witin the 3 years.
Typically, if a H1 extension (with the same employer) is approved, I-94 would have the SAME I-94 number. | ||

Friend got RFE on extension and answered RFE and after 1 week got 3 yrs extension Lawyer put in another Extension petition with new job description on the next day RFE was answered and got approved with 1 yr extension after the 3 yrs extension was approved. Once the 3yr was approved Lawyer put in a cancellation request for the second petition before it got approved. So far no action on it. So which petition should he use 3yrs one or the 1 yr one? |
