As a matter of fact, their yeas is also addressed in the law as a business entity protection at very abstract level. But many details if you see an average MSA or any agreement document which we sign at the bottom of that gigantic stack of multiple pages, many details pinch us real bad(especially if you are an independent contractor, it pokes real deep in the wrong places). Payment terms, notice period, non-exclusivity(I read in one agreement saying "you cant accept/do any full time or part time other opportunities without our permission" while they cant even guarantee to pay for minimum 8 hours a day without client approved time sheet. I gave a Fkcu for that agreement though, but many hidden. We, usually got from our background in India, tend to sign at the bottom of the page for any agreement. I dont do that, since in US, everything goes by book at the end, if there is a dispute. Just my word of caution for everyone: Please dont sign at the end of page without knowing what is in the page. (for any agreement including your auto insurance, life insurance, rental agreement, mortgage papers, credit card application etc..) | ||

you do not specifically need them. federal/state laws cover them. as long as you have approved time sheet, they are supposed to pay us. if not, we can go to labor department and it is very serious crime. kanee mana consulting gaallu use us as slaves and they know that we do not go to labor dept because of visa fears. unless... he states in the contract that - he pays you if and only if other guys pays. I always see MSA(Master Services Agreement) etc exists to save the IT company yeas from the candidate and others. I am trying to find a candidates agreement for IT consulting company (say if they dont pay, if they abuse you, if they dont execute any written promise etc). Did you guys come across any such agreement sample, template etc? I didnt so far. |
