Thanks for all the replies. I 94 is sought for L2. His wife has valid visa until nov 2019. He knows he can legally stay but he will not get his EAD extn and therefore cannot work until i 539 is approved. He wants to get his stamping done but doesn't his daughter to miss school. Please suggest. | ||

my wife travelled when her f1 to h4 i539 is pending , she got stamped when in india and came back fine. after a month or so we received a letter from uscis stating that her application (old one) is being denied as she travelled when in process. in your case i am not sure how it works out when two applicants are on the same application. please check in lawbench.com | ||

What was the original visa that the I-94 extn sought for ? B2 or H1? Regardless, as long as the Request is pending, they are legal to stay in US. But once the decision is made, from that date, technically the decision is valid. If the decision is REJECTION, there will be quite a short time to get out of the country(say few days) from the date of decision made(not form the date of the communication received). | ||

One of my relatives visa is going to expire in Mar 2018, he applied for I-94 extn (I-539) for him and his daughter in Dec 2017, still waiting for an update. As it is going to be too much delay he is planning to go to India in first week of Apr for stamping. can he go alone and get his stamping done? his daughter's I-539 will still be processed? Please suggest. |
