from trackitt This is not a new thing..previously all additional documents were submitted after RFE.. The only new change is now they need to submit this with the initial application packet. These docunents were purposely held up by attorneys in anticipation of an RFE so once after RFE was issued as a a boiler plate template and they used to submit the additional docs. Now its different as they need to submit initially and anticipate straightforward approval or some new unknown RFE. We have to wait and see what kind of RFEs they will start sending...if they demand contracts between Vendors-Clients or SOW...most of the people will get short extensions.....I always got six-month extension from the client but got 3-year letters....if they start demanding SOW...we r fcuked. | ||

This has been happening for the past 10 years(one year/ 2 year /3 year random approvals). Its not new. This notice doesnt have any legal ground from the books of INS. Its just the mood of the approving officer and the strength of the lawyer to legally defeat any illegal RFE. | ||

Previously they used to give extensions for three years irrespective of project duration...although for the past few years many have got one year extensions...based on luck...now this memo is explicitly saying that extensions will be based on exact project duration.....I always got three year extensions before...no such luck in future | ||

1. Make sure u dnt have 55k, 60k, 70K LCAs.... kakkurthi padakani... show ur position as a Sr. position (which most of us are)... 90-100k LCA is safe bet... pretty common ayyindi takkuva LCAs ki rejection because they are not specialized skills... unnadi unnattu pettandi experience or salary requirement.. 2. Education background kuda matter of concern ayyindi... if u have a non IT/ENGG background, be ready to show that u have undergone training in the required software/applications and got certification(s)... some kind of documentation which shows ur capable of doing the job ... 3. U must have a specialized skill as per the latest requirements... so make sure ur title, roles and responsibilities reflects that... regular job titles vaddu (like systems analyst, programmer analyst, computer programmer)... This advice came from an attorney to my friend's employer... 4. Payroll aithe we all know... assalu GAP undoddu and i dnt think any employer is doing it now... 5. Always have the approver LCA and file for amendments before u start the job.. dnt step at the client site before doing this... | ||

good news and bad news: USCIS acknowledges that EVC/EVVC/EVVVC/EVV*C models are valid. However, entire itinerary is part of approved H1B. So, if the vendor changes in between or project ends at the end client for a given approved H1B, that H1B is no longer valid.
