No worries here. Have your friend's new employer file another H1 (transfer) immediately. Review the real reason for the denial and fix that issue or if its not mandatory , avoid such clauses in the new petition. Here is the fact: 1) H1 is not singleton. Each employer owns their own petition(approved or denied). 2) There is NOTHING called TRANSFER of a visa in the Immigration books, each time we are applying for a NEW H1 petition(only diff is, if it needs to be counted in the new quota or it was a part of previous quota). 3) If a H1 is denied due to the issues with employer(including the job details, wages etc), Employer should file another petition by fixing those issues. This doesnt impact another employer filing for the same candidate. 4) If a H1 is denied due to the fraud etc on the employee(candidate) part, regardless of any employer, all H1s suffer for the same candidate. Having said that, there is nothing to be worried. Nice analysis and mitigation of the issue can be handled. Also lately there is an extended (around 60 days??) period of grace period to find alternative employer if a petition is Denied. | ||

for you to be safe, you need to fast forward the result - whatever it might be..if your previous h1 hasn't been revoked, then you don't have to fast forward it.. in your case, you know a withdrawal has already been submitted..so if you fast forward the result, you will have a choice if the petition is denied..else you have to swim with your hands tied | ||

it will help if you get a denial on your current petition AND your previous h1 isn't revoked yet (it doesn't look like it has been revoked).. these are the situations you can be in: 1. Approval on current petition - your prev h1/i-94 validity is a moot point here 2. Denial on current petition before July 2018 AND your prev H1 hasn't yet been revoked by USCIS - you are in valid status (without work authorization) so you need to file for another H1 immediately 3. Denial on current petition before July 2018 AND your prev H1 has been revoked by USCIS - you are out of status from the date your prev H1 is revoked..so you need to file for another H1 immediately and when it is approved, go to india get it stamped and come back 4. Denial on current petition after july 2018 - you are out of status..need to file another H1 and when it is approved, go to india get it stamped and come back so it is in your best interest to upgrade your current h1 to premium... | ||

Circa 2008. Some date in August. I got news that my H1-B Transfer was rejected. Cut chesi flash-back loki velthey, I came to US through Infosys H1-B in May 2007. 2 months, 2 pay-slips ke transfer pettesaa, to a consulting company because I so badly wanted to quit Infy. SPM asked in exit interview, aren't you ashamed? I said, I am not, when Infy is not ashamed when my short-term transfer allowance requests were denied by PMs and SPMs in India, while visiting cities like Pune and B'lore for 4 week and 5 week stays for Project related travel, then why I should I be ashamed for leaving a company like that, before or after H1-B Visa, does it even matter? Anyhow, did not initiate Premium Processing with Visa Transfer Case to Consulting company. The transfer case took it's sweet time. Meanwhile, some angel investor from Chicago dumped some money into the consulting company. After 4 months turned out, that angel investor had fraud charges and investigations ongoing in Chicago. Consulting company was black-listed, after a few months my transfer case got RFE, after replying to RFE and upgrading to Premium, Case denied in August. Quickly moved to another Consulting company, been with them now for close to 10 years. I am now a Cash Cow. They have never made so much money with any consultant, even in terms of hourly rates, I am a record-break. When H1 Extensions and Transfers are denied, you'll get grace period of 30 to 60 days, that'll be specified in the Denial document. Find another company and file H1 Transfer with Premium. Without Premium is also just fine, a pending H1 Case with valid I-94 is sufficient reason not to be deported. All the very best. "Chill Bro. I told you to let it go!!" - The Budhha. | ||

talking to attorney is always safest. I believe a person can be out of status for less than 180 days, without effecting his potential legal admissibility. This is the law (unless something changed in last few years) | ||

too many denials in recent weeks...just too many.. have your friend check the status of his Infy H1 online...if it is still active, he is technically not out of status...ventane inko h1 file cheyatame i've seen two cases where a denial is followed by an approval..iddaru out of status ayyaru (as their previous h1 expired) so they are leaving the country to get h1 stamping done to get back to US | ||
