i-94 expired, but h1b extension is in processing? only problem is h1b extension is applied after the expiry of i-94. ok to wait until h1b extension goes through and then go for stamping? | ||

I94 is what drives ur status when u r in USA. VISA STAMP is just for entering USA and has no importance once you are inside USA. | ||

My wife came to US on H4 visa which is valid till Apr 2018 but she has her updated I-94 till Jul 2019 (she got this based on my H1 amendment for a location change, we requested the officer at POE to use the date based on my latest I-797). On her I-94 the status is H4. Q1. Do I have to file I-539 for extension of status? Q2. We are applying for her H1 this year (2019 quota), does it create any problem? |
