Got this from my lawfirm... H-1B Pre-Registration It is possible that all companies petitioning for H-1Bs in the upcoming H-1B cap rush will be required to pre-register for a spot in the annual quota, per a 2012 proposed rule that DHS now plans to invoke. Under this rule, companies would only file H-1B cap-subject petitions if they are chosen in this pre-registration lottery. It remains to be seen whether DHS can marshal their resources and systems quickly enough to roll out this pre-registration process in time the upcoming cap season. We have already started identifying and planning for H-1B cap-subject petitions for our clients and will prepare each of them as we have done in past years in case DHS cannot roll out their pre-registration process quickly enough. |
