is it H1B approval date OR your US Arrival date? Your time count starts from the date of your arrival till the date of your departure. Dates on your approval doesnt count if you are not in United States(in the given visa). Ex: You arrived in US on H1 status on date1, went to India to eat chicken on Date2, came back on date3. Time between date2 and date3 can be recaptured. Time count starts only from date1 (even you had an approval stamped before). One more example: You got H1 approval/stamping on date1(printed on the visa/approval), you entered into US on date2 in H1 status, went to India on date3, got married, came to us on H4 status on date4, got an employer filed your h1 on date5 and kept on working in us till h1 date6 and changed to h4 on the same date. here you are in h1 status only between (date2 and date3) and between (date5 and date6) rest of the time you can recapture for h1 | ||

Yeah H4 will be better..other option people follow is file for B2 ..with cover letter saying you will wrap up things and leave by certain date.. buy a refundal one way yicket and cancel after filling.. Meanwhile apply for 140 in premium as soon as you get labor perm copy..then apply for h1 | ||

I-94 date is final, it overrides any other dates. Listen to the Lawyer. They are correct. Till early 2000s, L1B used to be 1 year on I-797 and I-94 used to be 3 years. Please listen to the lawyer | ||

I-94 you can stay, H1 you can work after Nov 30, you can take leave, for one month as it is december and dont work. once H1 applied,you can start work or option -2 apply H-1 ext saying PERM approved, but dont attach PERM as you dont have handy..once the RFE comes then attach PERM and get one year extension.. simple case.... | ||

H1 allows you to work. I-94 allows you to stay. Both are different. You can stay in the country as long as your I-94 is valid. For example: B-1 visa may be for 3 months. That means, you can enter the country in those 3 months. But, when you enter, Immigration guys can give I-94 for 6 months. so, you are allowed until that time. you can even extend it for another 6 moths. and stay for another 6 months. please note your visa expired 9 months ago. so, your visa is different and your i-94 is different. my current situation - 1st h1b 10/1/11 recapture time - 60 days based on this max out date - 11/30/2017 (apprx.) I-94 date H1B - 1/31/18 PERM approved on 10/25/17; waiting for certificate - by current trend it will not come until after 1 month i.e., 11/25/17 Company attorney said - if I-94 date is 1/31/18 ur six years date will be 1/31/18. my argument, it won't work like that ... cis will give whatever u put on 129 ... she said are u an immigration lawyer ... naa maate sasanam ... nenu - nee bonda, undu ccdb lo kanukkuni chebtanu ... nenu correct aa or attorney correct aa? P.S: inta varaku em chesav ani dobbulettoddu ... ala kalisochindi ... konchem g b konchem ade g lo unna s anukondi ... so past tavvakunda present matter matadukundam ... evaranna past ni kelikite thread del chesi dkuta ... warning!
