Feb 2019 ki will she complete 36 months of OPT (12 months initial OPT + 24 months STEM OPT extension)? I suggest using the OPT to look for jobs and mention to any potential employers that she doesn't need sponsorship since she can always move to H4 EAD my wife was in the same situation luckily she found FTE who was willing to sponsor her H-1B | ||

Summary: DHS has asked for abeyance of the case till Dec 31, 2017. USCIS and DHS is evaluating H4 EAD rule in accordance with the Presidential Buy American, Hire American policy. DHS promises to update the court if the policy decision is taken prior to the end of the year. The court is likely to grant this additional 90 days extension as it is well known that OMB (Office of Management and Budget) releases it policy agenda by the end of the year.
