HE cannot do anything. A similar issue happened to my friend. He bought the 2013 sienna in 2014. He was very happy that he got good deal. It was highest trim level and he got it for 24k or something. The car oil change guy recognized it and informed the structural damage to my friend after a couple of months during an oil change. He went and spoke to dealer and dealer said, all sales are final and the report did not have any history of an accident during the sale. he is not responsible. He went to Honda dealer and traded in the vehicle with the 5k loss. He could not do anything. | ||

But don't let the dealer know that your friend is in hurry,he will take advantage of situation and may say,he will rectify it or replace the car with in a month (or some time) Just warn him that you will be file criminal charges/suing him and Toyota ;and also going to press But if you involve Toyota ,it may be resolved soon,as they will be scared of 'Bad press' | ||

I suggest best to sell the car to dealer who sold him, though it is 1 or 2k loss than expected value. I agree your friend has a valid case, but again he needs to spend time to handle the case, lawyer consulting fee and other miscellaneous expenses, by considering all these facts he is not going gain much out of it based on the car price, so it is better to make a deal with the original dealer. | ||

i suggested the following to him..(in case he cannot find a lawyer by tomorrow) 1. Give dhamki to dealer that he is going to report to Police and Sue him and also report to Toyota about the dealership, as to how can they sell Structural damage car as Certified with 2000 inspection points 2. ask for money urgently with immediate settlement, as he needs to pay another dealer for a new car which is on hold for him | ||

Cheapest option is complain with used car dealers association about the fraudulent practices and also to local authorities and local press The dealer may buy back and settle in between ,at the max (if he is worried about the reputation and if you have strong proofs (read fine print in the invoice.It may say 'as-is-condition' and you inspected and agreed to buy after you are satisfied with it etc) BTW if the dealer has body shop and is separate business from car dealership,technically he may not be responsible for delayed reporting | ||

What is the current offer for the car and what it would have been if there was no structural damage? Unless the difference is huge, it's a waste of time and money on an attorney. You also have to find out if the delay was by carfax or by the dealer. | ||

naa aapice lo kurrod going back to India for good..next week...trying to sell his car.. history/timeline of events. 1. He bought a Certified car from Toyota 2 years back, after checking in Carfax that there was a minor accident reported against it 2. Tried to sell it yesterday to another dealer, who checked and said, that his car has structural damage and it was reported on Carfax after 1 week of him buying from the dealer 3. The dealer also has a body shop 4. Looks like the dealer bought the accident car, fixed it and marked it as Certified and sold to this guy and later reported about the Body damage to DMV 5. It is a clear case of Dealer Fraud.. he needs help to find an attorney..basically what kind of attorney can fight this case .. evarikaina already telisina Attorney unte ivvandi please..kurrod lives in NJ timing wise...it is bad, as he is flying back to India for good next weeek |
