this is my understanding too...oka paali 140 approve aithe employer cannot revoke it after 6 months...and based on the i-140 approval, u can get unlimited number of extensions on H1..there is no rule that this 140 should be from current employer...kaakapothe mee friend case lo 140 already revoked kaabatti ask him to contact a lawyer...I have read many stories on Murthy.com where they got H1 extensions even on revoked 140's...oka $100-$250 manadhi kaadhanukunte ask him to contact attorney,DB suggestions meedha immigration decisions theeskotamante too much yaa.. | ||

Oh keep a close tab on the progress.. if 140 is already revoked it may be tricky with h1 extension without labor approval at least.. you will retain priority date even if revoked but h1 extension may be little tricky... I think if labor application is at least pending then you shouldn't have any problems.. | ||

friend situation...answers pls... approved I140 with employer 'A'. stayed 6 months after I140. 5th year of h1b. old employer kept it active for 6 months and then withdrawn 140. Moved to company 'B'. used old 140 to get 3 yrs h1b extension.. 'B' started filing GC process but doing slow. worried that his new 140 with company 'B' may not come before new h1b expires ... kochen is...with the new rules, can he still use 'A''s 140 to get any number of h1b approvals after 6 yrs even though 'A' withdrew it ? I think once you control the man inside of you, the one across from you doesn't really matter. |
